In a letter dated July 9, 2004, from Stephen C. Fearn (President of Gold King) to the Division, Gold <br />King advised the Division that it did not have sample data for the monitoring periods covering April 1, <br />2004 to July 9, 2004 even though the Facility was in operation during this time period. In addition, in <br />the letter, Gold King advised the Division that it would resume sampling during the week of July 11; <br />2004. <br />18. On August 20, 2004 the Division received discharge monitoring reports from Go1d.King for the <br />monitoring periods of April, May, and June, 2004, containing monitoring data for the parameters.pH, <br />'Oil & Grease, and Flow. In a subsequent phone conversation between the Division and Steven C. Fearn <br />(President of Gold King), Mr. Fearn reported that he had conducted field sampling in thatperiod for the <br />above-mentioned pazameters, but had not conducted testing for the parameters Total Suspended Solids, <br />Total Cadmium, Total Copper, Total Lead, and Total Zinc. <br />19. Gold King's failure to perform effluent parameter monitoring, as identified in pazagraph 16, constitutes <br />violations of Part LB.1. of the Permit. <br />NOTICE OF VIOLATION <br />Based on the foregoing Findings of Fact, you are hereby notified that the Division has determined that Gold <br />King has violated the terms and conditions of the Permit as follows: <br />20. Part I.A.1., which states in part, "...the permitted discharge shall not contain effluent parameter <br />concentrations which exceed the following limitations..." <br />a. The Daily Maximum effluent TSS concentration listed in paragraph 12 of the Findings of Fact <br />constitutes a violation of the Daily Maximum effluent concentration limit of 30 mg/1. <br />Gold King Mines Corporation <br />Notice of Violarion/Cease and Desist Order <br />Page S of 11 <br />
