b. The Daily Maximum effluent Total Copper concentration listed in paragraph 12 of the Findings of <br />Fact constitutes a violation of the Daily Maximum effluent concentration limit of 0.3 mg/1. <br />c. The 30-Day Average effluent Total Zinc concentrations listed in pazagraph 12 of the Findings of Fact <br />constitute violations of the 30-Day Average effluent concentration limit of 0.75 mg/1. <br />d. The Daily Maximum effluent Total Zinc concentrations listed in pazagraph 12 of the Findings of Fact <br />constitute violations of the Daily Maximum effluent concentration limit of 1.5 mg/1. <br />e. The Daily Maximum effluent pH measurements listed in pazagraph 12 of the Findings of Fact <br />constitute violations of the DailyMaximum limit of 10.0 s.u. <br />f. The Daily Minimum effluent pH measurements listed in pazagraph 12 of the Findings of Fact <br />constitute violations of the Daily Minimum limit of 7.0 s.u. <br />21. Part I.B.1., which states in part, "..the permitee shall monitor all effluent parameters at the following <br />frequencies. Such monitoring will begin immediately and last for the lifetime of the permit unless <br />otherwise noted." <br />a. The Failures to Monitor listed in pazagraph 16 constitute violations of the requirements of the Permit, <br />Part LB.1. . <br />CEASE AND DESIST ORDER <br />Based upon the foregoing factual and legal determinations and pursuant to §25-8-605, C.R.S., Gold King is <br />hereby ordered to: <br />22. Cease and desist from all violations of the Colorado Water Quality Control Act, § §25-8-101 through <br />25-8-703, C.R.S., permit regulations promulgated thereto, and the Permit. <br />Further, the Division hereby orders Gold King to comply with the following specific terms and coriditions of <br />this Order: <br />23. Within thirty (30) calendaz days after receipt of this Order, Gold King shall provide a writtenstatement <br />describing those actions that have been or will be taken to ensure that future effluent pazameter <br />monitoring and reporting will be performed as required by Part I.B.1. and Part I.E. of the Permit. <br />24. Within forty-five (45) calendaz days of receipt of this Order, Gold King shall retain the services of a <br />qualified individual specifically experienced inmine-related wastewater treatment to perform a detailed <br />evaluation of the Facility's treatment methods and technologies. This evaluation shall be conducted <br />consistent with the goal of identifying and rectifying the Facility's inability to produce efflueht that is <br />regularly in compliance with the Permit effluent limitations.
