13. Total Copper,.Total Zinc, pH and Total Suspended Solids aze "pollutants" as defined by §25-8-103(15), <br />C.R.S. and its implementing permit regulation 5 CCR 1002-61, §61.2(76). <br />14. Gold King's failure to comply with the Permit effluent limitations, as identified in paragraph 12, <br />constitutes violations of Part I.A.1. of the Pemut. <br />Failure to Monitor Effluent Parameters <br />15. Pursuant to Part I.B.1: of the Permit, Gold King is required to monitor defined effluent pazameters at <br />specific frequencies. Part LB.1: of the Permit specifies that all pazameters except for Total Dissolved <br />Solids aze to be sampled weekly, while Total Dissolved Solids aze to be sampled quarterly. Pursuant to <br />Part LC.6. of the Permit, a week consists of Sunday to the following Saturday, inclusive. <br />16.
