Christy understands <br />that in order to conduct mining operations hereunder, Grace ~~ <br />may be required to obtain mining permits, rezoning and other <br />appropriate approvals from the State of Colorado, Routt <br />County, and the appropriate agencies having jurisdiction. <br />Christy desires to encourage Grace in such efforts, and, to <br />that end, Christy consents to such efforts by Crace and <br />agrees to support and cooperate fully with Grace in such <br />efforts, Crace to pay all costs incident to such permits. <br />8. Development of Other Minerals. Christy agrees~~ <br />that he will not, personally or by agreement with any person <br />or entity other than Grace, explore for, develop or extract <br />minerals from the Property without Crace's prior written <br />consent (which consent shall not be unreasonably withheld), <br />(~ and in any event in any way which would be inconsistent with <br />Grace's rights under this lease or which would adversely <br />affect its operations hereunder, it being the intention of <br />the parties that Grace's rights under this lease to extract <br />coal from the Property shall be dominant and shall not be ~ <br />hindered in any way by activities of any other person or <br />entity directed toward the exploration, development or extrac- <br />tion of any mineral other than coal. It is agreed that Crace <br />will not object to, or withhold its written consent as a <br />result of, the provisions of any such agreement relating to ~' <br />rental, royalty or other payments to Christy, since Grace has <br />no financial interest in the minerals other than coal, oil <br />and gas. <br />9. Surrender. This lease may be surrendered by <br />Crace at any time by giving Christy notice of its intention <br />to surrender in the manner provided in paragraph 12. , <br /> 10.
