<br />~~ ~ sooR445 PncF 183 <br />Christy shall have the right to give written notice of such <br />default to trace and if Grace does not cure such default <br />within ninety days after receipt of such notice (or, if the <br />event of default is the non-payment of money to Christy by <br /> <br />Grace, within thirty days after receipt of notice), or .. <br />I <br />commence action to cure such default within ninety days <br />after receipt of such notice and thereafter diligently <br />complete such curative action, Christy may cancel this <br />Mining Lease or take such legal action as he may see fit to <br />require performance by Grace, provided, however, that any <br />action or nonaction by Grace which is caused by casualties, <br />strikes, legislation, public regulations, storms, floods, <br />dCt9 of God, civil disturbances, military disorders, insur- <br />rection, riots, fire; accident, explosion, or other causes <br />beyond the control of trace shall not be considered as <br />defaults. In such case, in the event that Grace intends to <br />rely on the event of force majeure, Grace shall notify <br />Christy in writing of such occurence within thirty days <br />after Grace discovers it. <br />11. Assignment. This lease may be assigned by <br />Grace to any corporation, partnership or other entity in <br />which it owns an interest without Christy's prior consent. <br />In addition, this lease may be assigned by Grace to any <br />other corporation, partnership, person or other entity, but <br />in such event Grace shall nevertheless remain liable far the <br />performance of the obligations contained herein unless <br />consent to such assignment is secured in writing from Christy <br />which consent shall not unreasonably be withheld. The <br />provisions of this agreement shall inure to the benefit of <br />and be binding upon the heirs, personal representatives, <br />successors and assigns of the parties hereto. <br />12. Notices. Any notices required or permitted <br />to be given hereunder shall be deemed properly given upon <br />. delivering or mailing, by registered or certified mail, <br />return receipt requested, if intended for Christy, to: <br />-6- <br />
