Dnty to Provide }nfnmtation <br />The pennitfee shall furnish to the Division. within a reasonable time, any information which the Division may request to <br />determine whether cause exists for modifying. revoking and reissuing, or temlinating this pemtit, or to determine compliance <br />with this penult. Except as provided in paragraph h. of this section, a pern»t may be transferred by a pemtittee only if the permit ha; been <br />modified or revoked and reissued as provided in 5 C'CR 1002-G1 Section G1.S(S) of the Colorado Discharge Pemtit Sysnm <br />Regulations, to identify the new permitter and to incorporate such other requirements as may be necessary undt_-r the <br />Federal Act. <br />h. A permit maybe automatically trans!'erted to a new pemtittee if: <br />i. "fhe current pemtittee notifies the Division in writing 30 days in advance of the proposed transfer date: and <br />ii. "fhe notice indudcs a written agreement between the existing and new pennitne(si containing a sltecific date for <br />tran5ler of permit respunsibiliry, nncrage and liability between them; amt <br />iii. The Division does not notify the existing permittee and the proposed new petmittec of its intent to modify, or revoke <br />and reissue the permit-, and <br />iv. A detemtination that the pennittcd activity endangers hummt he5lth or the classified or existing uses of state waters and <br />can only be regulated to acceptable levels by pcnnit modifications or terntination. <br />b. A pemtit may be modified in whole or in pan for the follow'im~ causes, provided that such modification complies t~ith the <br />protasu)ns of 5 CCR 1002-61 Section 61.10 of the Colorado Dischar~~e Permit System Regulations: <br />i. There arc material and substantial alterations or additions to the permitted facility or activity which occurred after <br />pemtit issuance which justit}'the application of permit conditions that arc different or absent in the existing pemtit. <br />ii. 17tc Division has received new information which was' not available at the time of pemtit issuance (other than revised <br />regulations, guidance, or test methods) and which would have justified the application of different pemtit conditions at <br />the time of issuance: For permits issued to new• sources or new dischargers, this cause includes infommation derived <br />from efttucnt testing required under 5 CCR 1002-61 Section 61.4(7xe) of the Colorado Discharge Permit System <br />Regulations. phis provtsron allows a nwdification of the pcnnit to include conditions that arc less strinLent than the <br />existing pemtit only to the extent allowed under S CCR 1002-G1 Section 61.10 of the Colorado Discharge Permit <br />System Kegulations• <br />iii. 77te standards or regulations at which the pemtit was based have been changed by promulgation of amended standards <br />or regulations or by judicial decision after the pern»t nos issued.
