Please address the following issues that were not noted in the PAR: <br />Within the Reclamation Plan: <br />1) Please indicate the rate and type of fertilizer to be applied to the slopes and floor <br />of the reclaimed areas. <br />2) Please indicate the rates of "pure live seed" in pounds per acre of the approved <br />seed mix to be distributed during the reclamation process. <br />3) Please indicate the type of and quantities of mulch to be applied per acre. <br />Will the mulch be power applied and crimped? <br />4) Please indicate the type of methods to be used for seeding. Is it broadcasting on <br />slopes, in which case seeding rates are doubled? Will the operator disc harrow or <br />chisel the soil prior to seeding? <br />Within the Mining Plan: <br />1) Please include a Secondary Containment Plan for the onsite storage and use of any <br />hazardous materials or waste. The plan should give specific details about the <br />construction of containment structures and estimated volumes to be stored on site. Fuel <br />for equipment, feed materials for a batch plant or any other petroleum products should be <br />specifically addressed. The Plan should also state that the Division of Minerals and <br />Geology would be informed of any reportable spill of a toxic or hazardous material within <br />the mined land permit area. "Such notice will be faxed to the Division, Minerals Program <br />Supervisor, Fax (303) 832-8106, within the same time frames required by permit, license, <br />notice, statute, rule or regulation governing the reporting of such spills to other <br />appropriate agencies." The fax shall include a call back number of the responsible <br />company official for DMG staff to use as a contact. <br />2) It is understood that the mining will be accomplished in phases. After Phase 1 is <br />complete, materials will be removed from Phase 2 to begin the backfill process of 1. <br />If Phase 3,4 and 5 are to be mined sequentially, how will the operator move materials <br />back to Phase 1 without crossing reclaimed land? Please indicate if a haul road will be <br />utilized to access Phase 1. If there is to be a road, please indicate the location, width and <br />estimated longest length so that the reclamation bond can reflect those costs accurately. <br />3) The text of the Mining and Reclamation Plan estimates 3 to 5 feet of overburden will be <br />removed and then replaced with 6 to 18 inches of topsoil. Please <br />supply staff with asoil /topsoil volume analysis that demonstrates that there is <br />enough overburden to establish the minimum of 3 feet of overburden, 6 " of topsoil <br />and have enough to backfill Phase 1 and the north part of 2 to an elevation of 5780 <br />as suggested. If there is not enough material to accomplish the backfill, the applicant <br />needs to identify a source for the remainder of the imbalance which should include a <br />signed purchase agreement or commitment for the specific volume from a third party or <br />commit to mining to a specific depth no deeper than can be adequately filled with material <br />on site.
