All issues noted have been clarified or
corrected in the PAR with the following notes:
1) For Staff's purposes in calculating the reclamation bond, a cash crop of alfalfa will be
used to establish a cropland use. The operator may at his discretion plant some other
crop if economics dictate a better choice at the time of planting.
2) In your response to issue number 13, you state that the Division has not questioned
those figures in the past. Please be aware that the specialists will always question an
exhibit if we feel it is lacking sufficient information to meet the rules. Every specialist has
their own areas of concern and what may be adequate to one, may not be necessarily
sufficient for another. The exhibit had no information other than flat rates for seeding,
fertilization and topsoil placement. Staff cannot ascertain what seed mix, rates of
seeding, rates of fertilization, topsoil verses overburden placement volumes or types of
equipment used went into the Exhibit and therefore was found to be lacking. The
answers were not found elsewhere within the application. These issues were somewhat
clarified within your responses to the PAR. However, other information is requested
herein is needed.
3) The seed mix noted in the PAR response indicates 4 wheat grass species, 1 wild rye and
1 ryegrass. The Division requests that the applicant modify the seed mix to include 2
different species of grass, such as needleandthread and possibly a rice grass, to replace
2 of the wheatgrasses. Also, there should be some shrub seeding with 4-winged
saltbush and possibly some sage or rabbit brush to create a more diverse environment.
