Buirden of Proof Requirements <br />The petmittee has [he burden of proof when requesting relief from [oral suspended solids (TSS), [oral iron and/or settleable <br />solids limitations. Relief shall be granted only when necessary and shall not be granted when [he permittee has control <br />over the dischazge. The permittee should endeavor to meet the primary limitations whenever possible. For ponds with <br />automatic dewatering structures, only dischazges through these strucnues aze eligible for the exemption. All manual <br />dewatering of ponds that are equipped with automatic dewatering rystems mast meet TSS and total iron limitations. If a <br />po¢d has prt y tttanual dewatering capability (no riser pipes or other automatic dewatering systems), relief is available only <br />[o [he extent required to regain necessary capacity required by regulations. Addi[iottal discharge flow shall meet primary <br />lintitadoas. The Division shall have final authority in determining whether relief is granted. Dischazges from outfalls <br />001a, 002a, 003a, 004a, OOSa, 006a, 007a, 008a, 009a and OlOa aze eligible for this exemption; outfalls 002b, 004b, 007b, <br />OOSb, 009b and OIOb aze not eligible for this exemption. Eligibility at outfalls 004a, 007a, OOSa, 009a and OlOa is subject <br />[o demonstration that ourfalIs 004b, 007b, 008b, 0096 and OlOb comply with limitations in I.A.l.b. at time of dischazge to <br />demonstrate that surface runoff caused the exceedence of primary limitations. All discharges shall be achieved in <br />ace;ordance with applicable state laws. <br />Documentation that the treatment facilities were properly operated and maintained prior to and during the storm event shall <br />be submitted with any request for relief as an attachment [o the Dischazge Monitoring Report (DMR) for the appropriate <br />period, and the Division shall determine the adequacy of proof. As part of this determination, the Division shall evaluate <br />whether the pertnittee could have controlled the discharge in such a manner that primary limitations could have becn met, <br />whether proper sediment storage levels were maintained and the ponds had sufficient water and sediment capacity for the <br />storm event plus other relevant factors. Weather station data may be appropriate for rainfall. <br />Fq rainf 1, to waive TSS and total iron limitations, it is necessary to demonstrate that discharge occurred within 48 hours <br />after measurable precipitation has slopped. To waive settleable solids limitations, it is necessary to prove that discharge <br />occurred within 48 hours after precipitation greater than the 10-year, 24-hour even[ has stopped. <br />~r snowmelt, to waive TSS and total iron limitations, it is necessary to demonstrate that discharge occurred within 48 <br />hours after pond inflow has stopped. To waive settleable solids limitations, it is necessary to prove [hat discharge occurted <br />within 48 hours after pond inflow volume greater than the 10-yeaz, 24-hour event has stopped. <br />See Part I.C. for Definitions. <br />
