I~ <br />I~ <br />5. Impacts to alluvial water rights (shallow wells) are expected to be minimal; because no de- <br />watering is proposed during any aspect ofthe operation. The two reservoirs will be enclosed <br />by a slurry wall, and the 24+_ acre area south of SH7 (Southwest Mining Area) will be mined <br />wet without de-watering. From State Engineer's Records there are 49 wells within 600 feet <br />ofthe permit boundary. Ofthese 49 wells, 8 ofthese wells that are shallow wells completed <br />to a depth of 20 feet or less, according to State Engineer's records. Although there is <br />expected to be none or minima] impacts expected to any shallow well, AI's consultant is <br />installing monitoring wells around the permit area's boundary, and contacting all shallow well <br />owners within 600 feet of the operation to determine if a shallow well is in use. If a shallow <br />well is in use, AI`s consultant will offer to measure the shallow well's depth, pumping rate, <br />pumping water level, and non-pumping water level in the welt, and an Agreement to continue <br />to monitor the shallow well during the site operation and specific measures to be taken in the <br />event that a shallow well is adversely affected by AI's operation. In the event a shallow well <br />owner within 600 feet does not agree to .enter into an Agreement, AI. will follow all <br />procedures ofthe State Engineer's Office before proceeding with the installation ofthe slurry <br />wall or the wet mining of the Southwest Mining area. AI's consultant has already initiated <br />these above measures, and expects to complete them before the conclusion of the County's <br />consideration of the Conditional Use Application. In the event these measures are not <br />completed in this time schedule, an Agreement with all shallow property owners within 600 <br />feet, or approval from the State Engineer's Office, will be completed before the slurry wall <br />is installed or any wet mining on the Southwest Mining Area is undertaken. More details on <br />water are also contained in the accompanying Exhibit G-Water Information of the DMG <br />application. <br />6. In addition to resolving issues related to alternative plant locations, hauling truck routes, and <br />water impacts during the Conditional Use process, AI will also be working to resolve issues <br />related to AI's previous mining activities on the Tucson Mine to t e Wort berming and <br />~j screem~~ ng plans along SH7, berming and screenma plans to mitigate visual impacts f soo me <br />}(~r'~~,1_ property owners to the northwest, berming and screening plans to mitigate visual and noise <br />~„L impacts o a property owner to the south of the Southwest Mining Area, and to minimize <br />1~ impacts to the same property owner's road which crosses along the western edge of the <br />Southwest Mining Area. AI is committed to working on these issues during the progress of <br />this Conditional Use application. <br />7. During the Flood Plain Use Permit process, the location and size of any berming for screening <br />purposes will be considered. AI has also initiated an application for aFlood Plain Use Permit <br />from the Adams County Department of Public Works, and expects this permit to be issued <br />before completion of the Conditional Use process. In the event the Flood Plain Use Permit <br />has not been issued before the Conditional Use process is completed, the requirement for this <br />Flood Plain Use Permit will be a Stipulation on the beginnine of any activities that would <br />affect the floodplain. <br />7 <br />
