The operation of the Conditional Use request are expected comply with the County's requirements <br />as outlined in Section 3-35 of the County's Zoning Regulations in the following manner: <br />r, <br />3-35-06-0 l -Mining Permit Required <br />A permit from the Division of Minerals and Geology of the State of Colorado is on <br />process and should be obtained before the Conditional Use process in completed. <br />Upon approval of the DMG permit, a copy of this approval will be provided to the <br />County. The results ofthe Conditional Use process may require Technical Revision(s) <br />and/or Amendment (s) to the DMG permit, and AI will initiate any necessary <br />Technical Revision(s) and/or Amendment(s) upon conclusion ofthe Conditional Use <br />process. <br />~ 3-35-06-02 -Excavation Setback from Adjacent Property <br />All mining setbacksfrom adjacent property, easement, irrigation ditch, orright-of--way <br />are 25' or a greater distance. <br />3-35-06-03 -Excavation Setback from Nearby Residence <br />No excavation will occur within 125' of any existing residence. <br />3-35-06-04 -Rock Crushers Setback from Nearby Residence <br />No rock crushers or other similar equipment shall be placed within Z50' ofa residence. <br />3-35-06-05 -Hauling Roads <br />Hauling roads within the premises shall be maintained in reasonably dust free <br />condition by the use of water sprays, chemical treatments, and/or speed limits as <br />needed. <br />3-35-06-06 -Hours of Operation <br />All mineral excavation, crushine, hauling, loading, sorting, or similar operations shall <br />only occur between the hours of 6:00 a. m. to 10:00 p.m., except by specific <br />permission ofthe Director ofPlanning and Development for specific periods oftime <br />for contracts requiring material during hours other than outlined above. The 6:00 a.m. <br />to 10:00 p.m. restriction does not apply to maintenance operations, except all <br />maintenance operations shal] be conducted in such a manner as to not adversely <br />impact any surrounding property. <br />3-35-06-07 -Two Feet of Water Bearing Strata <br />Not applicable, since permanent lakes and backfilling of other areas to create <br />farmland, upland/meadow or wetlands are the proposed reclamation plans- <br />:8 <br />
