A Class III cultural resource survey <br />• vrill be required on all potential irpact areas should coal <br />development tape place. <br />Criterion t;o. 8 -- Ratural Areas <br />Analysis: The criterion is not applicable because no natural <br />awes or Rational P;atural LandrzrRS are present en the <br />_ federal lands. <br />Special note: For Criteria i;os. 9 to 16, Cclorado State Cffice Briefing <br />tJo. 46 (1-19-79) eras used to er.pand the meaning of the original <br />• criteria. <br />Criterion No. 9 -- Federally Listed Endangered Species <br />Analysis: Lo legally designated critical habitat for federally <br />listed endangered species is located on these federal <br />lands. However, during the winter a bzld eagle does use <br />. the riparian vegetation along the southern portion of these <br />federal lands adjacent-to the i;orth Ferk giver. The intake <br />ventilation shaft proposed by ':;esters Slope Carbon in their <br />short-term lease application lies vrithin tl•,e riparian <br />habitat. Approximately 1.5 acres of perr,~anent surface <br />disturbance r.~ould result to the area fro:.: the constructior, <br />of the vent shaft. The criterion, ho;rever, reeuires that <br />the habitat be of essential value as deten~~ined by u"LFi znd <br />_ the U. S. Fish and i:ildlife Service (USF;dS;. Consultatiora <br />as required by Section 7 of the Endangered Species Act have <br />been scheduled. <br />dt is, therefore, possible but not certain that this <br />criterion applies. If, as a result of the consultation, <br />the criterion is found to apply, the USF:,S r+ill also be <br />requested to consult with BL.•. on the effects of the <br />• <br />
