The permittee shall amend the plan whenever [here is a change in design, constmc[ion. operation, or maintenance which has a significant effect on the potential for the discharge of pollutants to the waters of the Slate, or if the SWMP proves to be ineffective in achieving the general objectives of controlling pollutants in stormwater dischazges associated with mining activity. Amendments to the plan shall be summarized in the Aanual or Compliance Report. 3. Prohibition of Non-stormwater Dsscharges a. Except as provided in paragraph b, below, all discharges authorized by this permit shall be composed entirely of stormwater. Dischazges of water other than stormwater must be addressed in a separate CDPS penni[ issued for drat dischazge. b. Dsschazges from the following sources that are combined with stormwater discharges associated with mining activity may be authorized by this permit, provided that the non-stormwater component of the discharge is identified in [he SWMP (see Part [.B.4.g of the permit): fire fighting activities, uncontaminated wmpressor condensate, irrigation drainage, lawn watering, air conditioner condensate, uncontaminated seeps and springs, and foundation or footing drains where flows are not contaminated. 4. Releases in Excess of Reportable Opsntities "This permit does not relieve the permittee of the reporting requiremenu of 40 CFR 110, 40 CFR 1 l7 or 40 CFR 302. Any discharge of hazardous material must be handled in accordance with the Division's Notification • Requirements (see Part II.A.3 of the permit). ' 5. Facility Inspections a. Active Mining Operations. Qualified personnel identified by the operator shall make a thorough inspection of their stormwarer management system, a[ least twice per year (in the spring and fall). Where semi-annual site inspections are shown in the plan to be impracticable because an employee is not stationed or does not routinely visit the site, inspections as required in this part shall be conducted at appropriate intervals specified in the plan, but never less than once in two years. These inspectioos must be documented and summari~r~t in the Annual Report (see Part I.E.1 of the permit). b. Inactive Mining Operations. Qualified personnel identified by the operator shall make a thorough inspection of their stormwa[er management system, at least once per yeaz. Where annual inspections are shown in the plan to be impracticable, because an employee is not stationed at or does not routinely visit the site, an inspection and certification is required once every three years by a Registered-Professional Engineer that the site is in compliance with the plan. These inspections must be documented and si~.nn,a,;~ei in the Compliance Report (see Pan I. E.1 of the permit). c. Remediation Operations. Qualified personnel identified by the operator shall make a thorough inspection of their stormwater management system, at least once per yeaz (in the field season). Where annual site inspections are shown in the plan to be impracticable, because an employee is not stationed at or does no[ routinely visit the site, inspections as required in this pan shall be conducted az appropriate intervals specified in the plan, but never less than once in two years.
