<br />GENERAL TERMS AND CONDITIONS: IIMPORTANTI READ ITEMS 8.7 AND 81 <br />• t. This permit is issued in reliance upon the accuracy and campletenese of information supplied by the epPlicent and is <br />conditioned upon conduction of the activity, or construction, installation and operation of the source, in accordance <br />with this information end with representations made by the applicant or epplieent'e agents. It is valid only for the <br />equipment end operetione or activity specifically identified on the permit. <br />2. Unless epecificelly stated otherwise, the gerteral and specific eondiriens contained in this permit have been determined <br />by the APCD to be necessary to assure compliance with the provisions of Section 25-7-114, C.R.S. end, as gush, shell <br />be enforceable under the provisions of Section 25.7-115, C.R.S., the Clean Air Act, 42 USC Section 75021b1131; end <br />Air Quality Control Commission Regulation No. 3 Section IV.0.2. or 121 result in en sxceedance of the NAAOS for <br />pollutants es required by Sections 25.7-105(111A)(1) end 2011111b1, C.R.S., of the Clean Air Act; 42 USC Section <br />7475(el(31; and Air Queliry Control Commission Regulation No. 3, Section IV.0.1 .c. <br />3. Each and every condition of this permit ie a materiel part hereof end is not severable. Any challenge to or appeal of, <br />e condition hereof shell constitute a rejeadon of the entire permit end upon such occurrence, this permit shell bs <br />deemed denied eb initio. This permit may be revoked et any time prior to final epprovel by the Air Pollution Control <br />Oivieion (APCDI on grounds set forth in the Colorado Air Quality Control Act end regulations of the Air Queliry Control <br />Commission IAQCC), including failure to meet any express term or condition of the permit, <br />4. This permit end any required ettechments must be retained end made available for inspection upon request et the <br />location set forth herein. With respect to a portable source which is moved to a new location, a copy of the revised <br />Air Pollutant Emissions Notice (APENI (required by law to be submitted to the APCD whenever a portable source is <br />rsloce[edl should be attached to this permit. The permit may be reissued to a new owner by the APCD as provided <br />in ADCC Regulation No. 3 Section III.B. upon a request for transfer o1 ownership and the submittal of a revised APEN <br />end the required fee. <br />5. Issuance (initial epprovel) of en emission permit does no[ provide 'final' authority for this activity or operation of this <br />source. Final epprovel of the permit must be secured from the APCD in writing in accordance with the provisions of <br />25.7-114.5 C.R.S, and AQCC Aepuletion No. 3, Section IV.H. Fnel approval cannot be granted until the operation <br />or activity commences end hoe been verified 6y the APCD es conforming in ell respects with [he conditions of the <br />• permit. If the APCD so determines, it will provide written documentation of such final epprovel, which does constitute <br />'final' authority to operate. <br />B. THIS PERMIT AUTOMATICALLY EXPIRES IF you 111 do not commence eonetrucdan or operation within 18 months <br />after either the date of issuance of this permit or the date on which ouch construction or activity was scheduled to <br />commence es set forth in the permit, whichever ie later; 12) discontinue construction for a period of 18 months or <br />more; or 131 do not complete construction within a reasonable time of the estimated completion date. Extensions of <br />the ezpiretion date may be granted by the APCD upon a showing oT good csuss by the pertnittee. <br />7. YOU MUST notify the APCD at least thirty days (fifteen days for portable sources) prior to commencement of the <br />permitted operation or activity. Failure to do so is a violation of Section 25-7-114.5(1211a1. C.R.S. and AQCC <br />Regulation No. 3, Section IV.H.1., and can result in the revocation of the permit. <br />8. Section 2 5-7-1 1 41511e1. C.R.S. requires that all sources required to fde an Air Pollution Emission Notice (APEN) moat <br />pay en annual lee to cover the costs of inspections end administration. If a source or activity is to be discontinued, <br />the owner must notify the Division in writing requesting a cancellation of the permit. Upon notification, annual fee <br />billing will terminate. <br />9. Violation of the terms of a permit which hoe received final approval or of the provisions of the Colorado Air Queliry <br />Control Act or the regulations of the AQCC may result in administrative, civil or criminal enforcement ecdona under <br />Sections 25-7.115 lenforcementl, -121 (injunetional. -122 Icivil penaltieel.
