Ms. Jennifer Lindahl Page 2 <br />Larimer Pit, M-74-069 <br />May 8, 2007 <br />The proposed sources of replacement water for this pit are 33.6 Barnes Ditch inches <br />diverted from the Big Thompson River and previously used for irrigation of the mined property and <br />67 acre-feet of Colorado-Big Thompson ("C-BT") Project water leased from the City of Loveland <br />("Loveland"). The Barnes Ditch inches, provide a dry year historic consumptive use credit of 31.49 <br />acre-feet, based on a field efficiency of 60 percent and a ditch loss of 5 percent. A dry-up covenant <br />has been provided for the Barnes Ditch water on March 22, 2005. Replacements during May <br />through October will be made by diverting the Barnes Ditch water, measuring it, and then returning it <br />to the Big Thompson River. Adequate flow measuring devices, satisfactory to the water <br />commissioner, must be installed for the administration of this replacement water from the Barnes <br />Ditch. <br />Replacement for depletions during November through April, plus shortages after Barnes <br />Ditch credits during July through October will be met by releases of C-BT water leased from <br />Loveland. For the approval period of this plan, Loveland Ready Mix leased 43 acre-feet of C-BT <br />water for March 1, 2007 through October 31, 2007, and 24 acre-feet of C-BT water for November 1, <br />2007 through February 29, 2008. Copies of the approved leases from Loveland were provided to <br />this office on February 9, 2007 and they are attached to this letter. The use of C-BT water as a <br />replacement source requires Loveland Ready Mix to comply with the Interim Rule issued by the <br />Northern Colorado Water Conservancy District ("District") in May 2005 regarding the use of C-BT <br />Project water in substitute water supply plans. A copy of the District's approval letter for the use of <br />the C-BT water in this plan was provided to this office on May 7, 2007 and is attached to this letter. <br />Per the Interim Rule, the net yield of the leased C-BT water is 50% of the net C-BT water delivered <br />to the appropriate river reach for depletion replacement. In accordance with the District's Interim <br />Rule, the 67 acre-feet of leased C-BT water committed to this plan will provide up to 33.5 acre-feet <br />of replacement credit. The C-BT water is approved for use in this substitute water supply plan <br />however, it cannot be used as a replacement source in a permanent plan for augmentation for this <br />site. In addition, winter releases of C-BT water to the Big Thompson River after October 31 typically <br />cannot occur. The Applicant shall contact Loveland to determine the possibility of delivering the 24 <br />acre-feet of C-BT water (approved for use from November 1, 2007 through February 29, 2008) <br />through its system after October 31, and shall notify the water commissioner of the proposed plan to <br />deliver C-BT water during the November through February period. The Applicant shall provide this <br />information to the water commissioner and this office by July 16, 2007. <br />I hereby approve the proposed substitute water supply plan in accordance with §37-90- <br />137(11), C.R.S. subject to the following conditions: <br />1. This plan is approved with the effective date of March 1, 2007, and shall be valid through <br />February 28, 2008, unless otherwise revoked or modified. If this plan will not be made <br />absolute by the water court action incase no. 2000CW142 by the plan's expiration date, a <br />renewal request must be submitted to this office with the statutory fee (currently $257) no <br />later than January 15, 2008. <br />2. Well permit no. 62009-F was obtained for the current uses and exposed pond surface area <br />of the gravel pit in accordance with §37-90-137(2) and (11), C.R.S. <br />3. The total surface area of the groundwater exposed at the Larimer Pit site after December <br />31, 1980 must not exceed 18.3 acres during this approval through February 28, 2008 <br />resulting in 35.69 acre-feet per year of evaporative loss. <br />4. The annual amount of water used for dust control shall not exceed 3.83 acre-feet, the total <br />product mined shall not exceed 16,488 tons per year resulting in 0.49 acre-feet of water lost <br />with product, and the amount of water used for concrete hatching must not exceed 11.23 <br />
