Total consumption at the Larimer Pit must not exceed these aforementioned amounts unless <br />an amendment is made to this plan. <br />6. Approval of this plan is for the purposes as stated herein. This office must first approve any <br />additional uses for which the water maybe used. Any future additional historic consumptive <br />use credit given (e.g., agricultural water transfer) for this site must consider all previous <br />credits given. <br />7. All pumping for dust control shall be measured in a manner acceptable to the division <br />engineer. <br />8. All releases of replacement water must be sufficient to cover all out-of-priority depletions in <br />time, place, and amount and must be made under the direction and/or the approval of the <br />water commissioner. The release of replacement water may be aggregated to maximize <br />beneficial use. The water commissioner and/or the division engineer shall determine the <br />rate and timing of an aggregated release. <br />9. The use of the C-BT Project water as a replacement source requires the Applicant to comply <br />with the Interim Rule issued by the District in May 2005 regarding the use of C-BT Project <br />water in substitute water supply plans. A copy of the District's approval letter as required by <br />paragraph 1(g) of the District's May, 2005 Interim Rule was provided to this office on May 7, <br />2007. <br />10. Winter releases of C-BT water to the Big Thompson River after October 31 typically cannot <br />occur. The applicant shall contact Loveland to determine the possibility of delivering the 24 <br />acre-feet of C-BT water (approved for use from November 1, 2007 through February 29, <br />2008) through its system after October 31, and shall notify the water commissioner of the <br />proposed plan to deliver C-BT water during the November through February period. The <br />Applicant shall provide this information to the water commissioner and this office by July 16, <br />2007. <br />11. The amount and location of the dry-up of formerly irrigated acreage associated with the <br />Applicant's 33.6 inches of the Barnes Ditch were documented in a letter dated March 22, <br />2005 as part of an engineering analysis developed in support of the change of water right <br />case no. 2000CW143. <br />12. The replacement water that is the subject of this plan cannot be sold or leased to any other <br />entity during the term of this approval. As a condition of the subsequent renewals of this <br />substitute water supply plan, the replacement water must be appurtenant to this site until the <br />plan for augmentation in case no. 2000CW142 is decreed. A copy of this approval letter <br />should be recorded with the county clerk and recorder. All replacement water must be <br />concurrent with depletions in quantity, timing and location. <br />13. Adequate accounting of diversions, cubic yards of concrete batching, tons of mined product, <br />water used for dust suppression, and replacements must be provided to the division <br />engineer and the water commissioner on a monthly basis or other interval acceptable to both <br />of them. The accounting form provided with your application is subject to modification and <br />approval by the division engineer. All amounts shall be in acre-feet, except concrete <br />batching, which shall be in cubic yards, and mined product, which shall be in tons. <br />
