Mr. Paul Banks
November 5, 1996
Page 3

mine start-up. The plan also must define what will be
considered an impact to the well and what mitigation action
will be followed when it is determined wells have been
impacted.
7. The application states that the expected direction of ground
water flow is northward toward St. Vrain Creek. Do you have
any supporting data or is your assumption based solely on
topography? Please explain.
8. The Division is concerned that the dewatering operation can
potentially lower the water levels in the wetlands areas
identified on Map C-2. Please include an analysis of the
expected impact to the wetlands and the measures used to
mitigate this, if required.
9. For bond calculation purposes, please state if any permanent
buildings, equipment or concrete footings or slabs requiring
demolition will be utilized on-site. The Division will also
need volumes and push distances of stockpiled overburden and
topsoil to evaluate reclamation costs. Please clarify where
topsoil and overburden will be stockpiled and the average
depth of each material to be removed and replaced during
reclamation.
10. Exhibit S identifies several on-site and off-site structures
within 200 feet of the affected area. Pursuant to Rule
6.4.19, notarized agreements have been submitted for the oil
gas well owned by Vessels Oil Company, the Last Chance Ditch
and the Weld County Roads. A geotechnical stability analysis
for the Sinclair pipeline has been submitted to the Division
which has been reviewed by Allen Sorenson of the Division
(response enclosed). Please respond to Mr. Sorenson's letter.
11. In addition to the list in Exhibit S, the Division has
identified the following structures:
a) The Seep Drainage Ditch is situated 30 feet south of
Phase 3.
b) An irrigation ditch is located approximately 100' south
of the Seep Drainage Ditch
c) An irrigation ditch extends from the Last Chance Ditch
northward across the central portion of Phase 2 which
crosses County Road 26 3/4 and enters the land to the
north. Zs this one of the laterals mentioned in the
application which will be relocated?
d) Power lines are located along County Roads 15 and 26 3/4.
The Division considers these as permanent man-made structures.
Please state whether mining will be conducted within 200 feet
of any of these structures. For those identified as such,
