The costs must be included <br />in the Exhibit L Reclamation Costs. <br />4. Provisions outlined in Rule 3.1.9(3) of the Mineral Rules and <br />Regulations require topsoil stockpiles to be stored in places <br />and configurations which minimize erosion. Map C-2 shows two <br />potential stockpile locations within the 100 year floodplain. <br />Please clarify whether topsoil stockpiles will be stockpiled <br />in these two areas. If so, they may be subject to potential <br />erosion from flooding. To minimize the potential for erosion, <br />the operator will need to commit to forming elongate <br />stockpiles aligned with the river. <br />5. It will be necessary to submit proof of compliance with the <br />State Engineer before disturbing the groundwater. This can be <br />in the form of verification of the well permit and application <br />for the well permit/augmentation plan. Please notify this <br />Division if the permit has been issued. <br />6. Pursuant to C.R.S. 34-32-116(7)(8), the Division is concerned <br />that disturbance to the hydrologic balance and to the quality <br />and quantity of groundwater be minimized during and after the <br />mining operation. Exhibit G states that some drawdown of <br />groundwater reserves as a result of dewatering is anticipated. <br />According to the well data listed in Appendix B of the <br />application, there are two shallow wells north of the permit <br />boundary. Permit No. 35646, permitted to Gilbert Acord, is <br />shown on Exhibit G-1, Ground Water Well Location Map. <br />Appendix B includes Permit No. 38262 (to Fred Craig) located <br />in SW,NW Section 32, T3N, R67W. Please explain why this was <br />not included on Map G-1 and make the appropriate change if <br />necessary, to the map. If there is indeed a well at that <br />location, could it be at the Timko residence as shown on the <br />Index map? A well in this area may be within 200 or 300 feet <br />of Phase 1. There are also a number of wells southwest of the <br />permit area, the closest being approximately within 600 feet <br />of Phase 3. <br />The application states that a piezometer has been installed <br />between the Acord well and spring and the mine area. Please <br />show this location on Map G-i and provide the completion data. <br />The applicant will need to submit a monitoring plan to include <br />at least three monitoring points including the Acord site. A <br />second monitoring point is needed for the Craig well mentioned <br />above and the third in the inferred upgradient position at the <br />nearest well south of the mine area. The plan needs to <br />include a schedule for monitoring groundwater levels at least <br />on a quarterly basis to begin at least five quarters prior to <br />
