<br />' <br /> There are limited areas 1n the permit area which are not <br /> included in a sediment control plan which has all <br />' discharges subject to the discharge limitations of the <br /> NPDES Permit. These areas are 1) the outslopes of the <br /> diversion ditches, 2) the outslopes of the catch berms <br />t around two topsoil piles and 3) the out slopes of two <br />sediment ponds. <br />' The mine has no railroads, haul roads, loadout sites, <br />storage sites, or other areas which are not under the <br /> control of the approved sediment control system. <br />' The mine was initially started in the early 1980's and <br /> operated under an approved permit issued by the Colorado <br /> Mined Land Reclamation Division. During the early stages <br /> of development, the company installed the appropriate <br />' sediment control system and contained the runoff of the <br /> disturbed area. Thereafter, the affected areas were <br />' stabilized by reseeding and revegating the exposed <br />ditches, berms, and other areas that were not within the <br /> confines of the sediment control system. Consequently, <br /> there are no plans for further disturbance or is there <br />' the need for any further implementation of control <br /> measures to achieve compliance with this plan. <br />' This plan will not include a schedule of activities for <br />construction or a timetable for implementation of further <br />activities since the construction of the applicable <br />' structures were completed in the early stages of <br />operations and have been subsequently revegated. <br />SPECIFIC REQUIREMENTS <br />a) A copy of this plan will be maintained at the field <br />' offices of Oakridge at 278 Sawyer Dr. Suite lA in <br />Durango, Colorado. <br />b) A Statement of Certification has been included with <br />this permit which has been signed by Sandra Pautsky <br />the Executive Vice President of Oakridge. <br />' c) The initial log of the activities of the <br />implementation of this SWMP shall be the first <br />' permit of the coal mining activities issued to <br />Pueblo Coal Inc., the previous wholly owned <br />subsidiary of Oakridge Energy, Inc. which is MLRD <br />' Permit C-82-054. It is on file with DMG and is <br />incorporated herein by this reference. No Further <br />log will be maintained at the mine unless further <br />disturbance is permitted beyond the existing <br />' approved permit. <br />
