u <br /> <br />C 5 C Sand must obtain certain governmental permits. Before <br />obtaining said permits, C b C Sand can remove certain rock, <br />sand and gravel from the Property for which permits are not <br />required. Stack agrees that C 6 C Sand may immediately begin <br />removing such rock, sand and gravel as may be allowed without <br />permit and that Stack will cooperate in all respects with C <br />b C Sand in C b C Sand's application for such permits as may <br />be necessary. Stack agrees that in the event C b C Sand cannot <br />obtain all permits necessary to maximize C & C Sand's Quarrying <br />Operation, C b C Sand may terminate this Agreement, upon fifteen <br />(15) days notice to Stack; provided that the minimum payments <br />paid to Stack shall not be refundable and C 6 C Sand shall <br />be liable for any additional payments based on tonnage removed. <br />(5) REAL PROPERTY TAXES. Stack shall be responsible <br />for paying the real property taxes or any assessments against <br />the Property. <br />(6) ACCESS. The parties acknowledge that access to the <br />Property is over a road or roads partially located on land <br />owned by an independent third party, who is not a party to <br />this Agreement (the "Fords"). Stack agrees that, at Stack's <br />expense, it shall ensure ingress and egress over said party's <br />lands for purposes of C b C Sand's Quarrying Operation. <br />With regard to the road on the third party's land and <br />on the Property, which C b C Sand uses for its C b C Sand's <br />Quarrying Operation, C 6 C Sand agrees to maintain said road <br /> <br />-5- <br />
