<br /> <br />C b C Sand shall not be required to make any payments <br />to Stack other than the minimum monthly payments, <br />If, however, more product is removed than the credits <br />that have been accumulated, then with the next monthly <br />payment C & C Sand shall pay to Stack such sums as <br />are necessary to pay for the product removed in excess <br />of the accumulated credits, It is accordingly the <br />intent of the parties that at such time as the mini- <br />mum tonnage has been removed from the Property that <br />the entire sum of $52,000.00 shall have been paid. <br />(c) Subsequent Tonnage Payments. Upon removal of <br />the Minimum Tonnage, the tonnage payments shall increase <br />from $,55 per ton to $1,00 per ton and shall continue <br />thereafter at the rate of $1.00 per ton through the balance <br />of the term of this Agreement, Such subsequent tonnage <br />payments shall be due and payable on the first day of <br />each month for all rock, sand and gravel removed during <br />the preceding month, <br />(d) C b C Sand agrees that at the end of each month, <br />it will provide Stack with reasonable evidence as to the <br />tonnage of rock, sand and gravel actually removed from <br />the Property during the said monthly period and with said <br />evidence shall tender to Stack any additional royalties <br />owed hereunder. <br />(4) CONTINGENCY.
