<br />if and while C b C Sand is actually using the same and shall <br />repair such deterioration to the road as is actually caused <br />by C b C Sand's use. C b C Sand shall not be required to main- <br />tain the road while it is not using the same. <br />C 6 C Sand shall be responsible for developing, building <br />and putting into use a new road as detailed in the easement <br />for such granted to Stack by the Fords. C 6 C Sand shall be <br />required to maintain such road only during such time as C b <br />C Sand is using the road. <br />(7) INSURA.vCE. C b C Sand agrees to obtain and pay for <br />comprehensive liability insurance with limits of not less than <br />Three Hundred Thousand Dollars ($300,000.00) per person and <br />Five Hundred Thousand Dollars ($500,000.00) per incident, and <br />shall name Stack as a co-insured thereunder. <br />(B) DEFAULT. In the event of a breach or violation of <br />the terms of this Agreement, the non-violating party shall <br />give notice thereof and the violating party shall have twenty <br />(20) days in which to cure the same. However, if any violation <br />cannot, with due diligence, be cured within twenty (20) days, <br />and the violating party diligently commences to eliminate the <br />causes of said violation and proceeds diligently to take steps <br />and to do all work required in curing the default, then it <br />shall not be considered a default hereunder. Failure to cure <br />the violation or default within the time limits above set forth <br />shall result in the non-defaulting party having the right to <br />-6- <br />
