M

Mr. Jack L. Hawkins -2- January lo, 1984
3. Although the Soil Conservation Service (hereafter, SCS) indicates tnat
topsoil has been removed from some areas years ago, not all of the area is
previously disturbed. A review of the data on soils indicates that topsoil in
some areas should be able to be salvaged to a depth of 19". You should
outline your plans for the salvage of all remaining topsoil on the permit area
for later use in reclamation and commit to such salvage. You should indicate
the location and probable depth of remaining topsoil on the permit area. You
should describe how this topsoil will be stripped and stockpiled as a part of
the mining operation.
4. Any topsoil stockpile remaining for one growing sea
J planted with a perennial grass cover crop for purposes of
against wind and water erosion. One recommendation would
wneatgrass at a broadcast rate of 16 lbs. PLS/acre (PLS =
J 5. Given the proximity of the Don Quixote Ditch to the
operation, several question areas arise:
son or more should be
stabilization
be Western
pure live seed).
proposed mining
a. The ditch company needs to be consulted about the mining
J operation. You must either show our Division that the ditch company has
an agreement with you Concerning compensation if the ditch is damaged
due to your operation (or is otherwise satisfied that no damage will
occur) or demonstrate more conclusively that the mining operation will
not damage the ditch and its functioning.
b. How close will the actual mining of gravel approach the ditch? A
very close approach, given the permeable nature of the material, will
almost guarantee leakage or physical failure unless compensatory
measures are outlined and taken.
c. In the text, this ditch is called the "El Coyote" ditch, and on the
map it is called the "Don Quixote" ditch. If this is one and the same
ditch, please let me know. If not, please describe where both ditches
are located.
d. Typically, a ditch company will have an associated ease~nent across
property such as that owned by Mr. Dawson. Furthermore, the ditch
company usually requires that the easement be undisturbed by other
activities such as mining. Please clarify the situation as concerns
such an easement.
e. Has relocation of the ditcn either during or after mininy been
considered?
6. What is the function of the drain pipe shown on the map? Will removal
of gravel to either side of it affect the drainage it provides?
7. Mining should not approach too close to fence lines of adjacent
landowners to avoid damage to their lands or fences. What set-back is to be
provided from these boundaries?
J 8. Is Cummings Gulch a flowing drainaye? If so, now will sediment due to
mining be kept from leaving the site and moving (via the drain pipe) into this
drainage?
