This review has resulted in several questions concerning the
application which are outlined on an exhibit-by-exhibit basis Delow. Any
exhibits, or parts thereof, not mentioned are considered adequate now. This
matter has been scheduled for the January 25-26, 1984 meeting of the Mined
Land Reclamation Board, to be held in Room 110 of our building, in Denver. If
we can resolve the various questions asked in this letter oefore the Board
meeting, this application will be able to be presented as a "no problem",
written matter, and you will not need to be present at the meeting. To that
end, please respond to this letter by no later than Monday, January 23, 1984.
This will give me time to review your responses and ask you any final
questions that I may have.
Proof of notification to the landowner of the proposed permit area, as well as
any immediately adjacent landowners (including the ditch company controlling
the Don Quixote Ditch) should be in the form of green Certified Mail return
receipts or originals of signed statements by these landowners demonstrating
that they have received notice (typically, a copy of the first publication) of
the proposed operation and the permitting process. These proofs should be
/ received by our Division before the scheduled Board meeting. The publisher's
affidavit (or a copy thereof) proving that the two sequential weeks of
publication have occurred should also be received by our Division prior to the
scheduled Board meeting.
Exhibit B
J 1.
