The Aspen/Pitkin Environmental <br />Health Deparrmerrt may require air monitoring to insure the effectiveness of dust <br />suppression measures. <br />4, Vegetable and flower gazdening or cultivation - No vegetables or flowers shall be planted <br />or cultivated within the boundaries of the Site except in gazden beds consisting .of not less <br />than twelve (12) inches.of soil containing no more than 999 parts per million.(ppm) lead. <br />The County has certified that institutional controls aze fully implemented and aze being <br />enforced throughout the Site. This certification is. documented through status reports which are <br />due to EPA every 6 months. These reports are part of the County's obligations under the <br />Consent Decree. The Consent Decree includes reopeners in the event that the County were to <br />repeal or disregard these ordinances. <br />E. OU2 Summary <br />The OU2 action memo outlined certain actions which were subsequently made part of an <br />Administrative Order on Consent with the mine site owners on April 19, 1995. An action memo <br />was used because of the simplicity of the response action. <br />Under the OU2 Scope of Work the following work has been completed: <br />• the top of mine dump #2 has been regraded to drain back into the <br />mountain, <br />• the lower parking area has been regraded to drain back into the mountain, <br />• control dust emissions from dirt roads and the parking azea by periodic <br />spraying of a magnesium chloride dust suppressant solution, and <br />• the existing fence has been extened to restrict entry to the properh~ to <br />eliminate risks to trespassers. <br />Separate from the CERCLA work the mine operators will later perform routine closure <br />actions. Disturbed areas other than mine waste dumps and developed areas will be revegetated as <br />part of those activities. Prior to cessation of mining activities, the fence will be extended around <br />the entire mine area, and the roadway and pazking area will be graveled or covered with asphalt. <br />~ 008 <br />PAGE No. 6 <br />
