The County agreed to and has implemented a cover and cap with 12 inches of clean soil <br />the following azeas - <br />a) Berm between the Racquet Club and the trailer pazk; <br />b) The azea north of the Racquet Club, between the club house and Park <br />Circle (the Mollie Gibson shaft azea); <br />c) The county owned property strip along the south side of Park Circle; <br />d) The Mollie Gibson Park azea; and <br />e) The fenced area south of the Racquet Club tennis courts. <br />3) The County is implementing long term monitoring and institutional controls. <br />Within fifteen (15) days of signing the consent decree, Pitkin County proposed <br />amendments to the Pitkin County Code to enact Institutional Controls (Land Use Restri:•tions) for <br />the Site. These institutional controls were reviewed and approved by EPA and enacted by the <br />City of Aspen and Pitkin County to restrict the movement of contaminated soils in and from the <br />Site and to aid in preserving the integrity of the remedy constructed at the Site. <br />The institutional controls are listed below. <br />No person shall undertake or conduct any activities or development within the Site <br />involving the excavation or exposure of more than one (1) cubic yazd of soil without first <br />obtaining a permit from the Duector. <br />Excavation and construction -Any disturbed soil or material that is to be stored above <br />ground shall be securely contained on and coveredwith a durable non-permeable tarp or <br />outer protective barrier approved by the Aspen/Pitkin Environmental Health Department <br />sc as to prevent the leaching of contaminated material onto or into the surface sail. <br />Disturbed soil or material need not be removed if the Aspen/Pitkin Environmental Health <br />Department finds that: (1) the excavated material contains less than 1,000 parts per <br />million (ppm) of total lead, or (2) that there exists a satisfactory method of disposal at the <br />excavation site.
