OS/O6/A7 1:.:18 FAX 303755355 CDPFIE 9AZ11AT • X006 <br />Order under which these parties agreed to perform certain studies for EPA <br />A Remedial Investigation/Feasibility Study (RI/FS) was conducted by Fred C. Hart <br />Associates, Inc. in March 1986. The recommended remedial action from the selection of two <br />alternatives was surface sealing (capping) and grading. <br />D. OUl Summary <br />In September 1986, EPA produced a Record ofDecision (ROD) which outlined a remedy <br />for OUl. The remedial objectives of the 1986 ROD were: <br />a) Removal and disposal of soils and tailings with lead concentrations greater than 5,000 ppm <br />in an on-site repository, <br />b) Capping of soils with lead concentrations between 1,000 and 5,000 ppm with 6 to. 12 <br />inches of clean soil and revegetation, <br />c) C~und water monitoring, <br />d) Provision of an alternate water supply for residences with domestic wells and, <br />e) Operation and maintenance of the remedy through regulaz inspections as well as through <br />land use restrictions, known as institutional controls. <br />During the OUl Remedial Design (RD), additional technical information showed that the <br />unexpectedly high volume of soils to betaken off site significantly changed the cost effectiveness <br />determinations of the Agency.Accordingly, the ROD was modified in the Mazch 1989 ESD. <br />This ESD described a plan to remove the top two feet of soils containing more than 1,000 ppm <br />lead in the residential areas and added an additional on-site repository for the extra volu: ne of soil. <br />However, the Aspen community found the remedy unacceptable. <br />The Aspen community submitted an alternative proposal which resulted in a second ESD <br />issued in May 1990. The May 1990 ESD included a greater reliance on local land use restrictions <br />known as Institutional Controls (ICs) and removal of 6 inches of contaminated soil in the Hunter <br />Creek and Centennial Condominium areas. <br />Pitkin County adopted ICs in May, 1991, but they were repealed based upon citizen <br />concern about the need for any remedy at all. EPA eventually resolved its significant differences <br />with the Aspen community and developed the course of action refleced in the June 1993 ESD. <br />PACE No. 4 <br />
