~I <br />' 11. Submittal and approval of a Floodplain Use Permit. Stockpiling material in the floodway <br />' must be shown to cause a zero rise is floodplain elevation. If stockpiling occurs in the <br />floodway, only temporary stockpiling shall be allowed. <br />13. Submittal and approval of a Final Drainage Plan. The existing drainage channel that <br />extends east from the intersecliotr of East IOOv' Avenue and McKay Road needs to be <br />addressed. It shall be located in a drainage easement large enough to accommodate flow <br />' and maintenance access. <br />14. The following transportation improvements ancUor payments in lieu shall be required by the <br />' applicant prior to commencing operations on the subject site: <br />a. Cash payment for future paving of the south % of 100's Avenue abutting Lot 2, Filing <br />' No. 1; <br />b. Obtain necessmy permits from either CDOT or Adams County, depending upon who <br />has jurisdiction, for the new entrance onto Brighton Road to include a left turn lane <br />from south bound traffic into the Plant Site area. Irr the event the access point is <br />under jurisdiction of CDOT and CDOT does not require a left turn lane, this <br />requirement shall be deleted; <br />c. Execution of an agreement with Adams County for the proportionate payment of <br />construction, repair and maintenance (or actual construction, repair, or <br />maintenance in lieu of payment) for that portion of Brighton Road under County <br />' jurisdiction commensurate with the impact of the traffic from the Plant Site on that <br />portion of Brighton Road under County jurisdiction. If required by CDOT, the <br />applicant shall enter into a similar agreement with CDOT for that portion of <br />Brighton Road under CDOT jurisdiction; rnrd <br />d. Execution of an agreement with Adams County and CDOT for a proportionate <br />' payment commensurate with the impact of traffic from the Plant Site for the <br />installation of traffic signaltzation at 104'h Avenue and Brighton Road and/or the <br />nonhbortnd ramp from I-76 to 96"' Avenue. As the location of the two signals would <br />' be under CDOTjurisdictton, in the event that CDOT does not believe that signal is <br />warranted at either or both locations, and/or if there is no mechanism for the <br />applicant to pay for a proportionate share of either or both these signals, this <br />requirement shall be deleted <br /> <br /> <br /> <br /> <br />
