Prior to construction or activity within 200 feet of the 230kv and IISkv electric lines, the <br /> applicmrt shall coordinate plans and encroachment issues with Public Service Company <br />I pursuant to the letter dated May 27, /999. In addition, these plans shall be provided to the <br /> Department of Planning and Development. <br />I 3. The 100 foot wrd 400 foot setback limits from the South Platte River shall be revised on the <br /> mining plan to match the line designated by the Urban Drainage and Flood Control District. <br />I <br /> 4. The applicant shall provide a permanent access easement to Adams County and/or Urban <br /> Drainage and Flood Control District for the maintenance of the river and dedicated to <br />I Adams County and/or the District as part of the approval. 77te access easement should <br /> extend no less than 40 feet beyond the top of the existing or master plan bank, whichever is <br /> furthest away from the river. <br />I <br /> S. The applicant shall obtain a Permit from the U. S. Army Corp of Engineers under Section <br /> 40.1 of the Clean Water Act prior to commencing any excavation and filling of a wetland <br />I area on the subject site. <br />' 6. The applicant shall obtain aRight-Of--Way Access Permit from the Colorado Department <br />of Transportation for access to Lot 2, Filing No. 3 and Lot 1, Filing No. 6 prior to <br /> commencing operations. Any use of either for the occasional use of truck traffic to export <br />I borrow material shall also require approval by CDOT. In addition, all access shall be fro <br />installing mining equipment, except as allowed by CDOT for temporary export access of <br /> borrow material. <br />I 7. The applicant shall obtain written approval from the Fullon Ditch Company for consmrction <br /> ojthe conveyor across the Ditch Company property prior to commencing operations on the <br />I subject site. <br /> 8. Applicant shall provide a spill prevention arrd release plan for fuel storage and fueling <br />I operations. Good housekeeping shall be practiced at this site. Spill and drip containment <br /> pans shall be emptied frequently and all spills shall be cleaned rrp and disposed of <br /> immediately. <br />I <br /> 9. Applicant shall demonstrate compliance with Air Pollution Control Division, and Water <br /> Ovality Control Division of the Colorado Department of Public Health and Environment. <br />I <br /> 10. Submittal and approval of Erosion and Sediment Control Plan. <br />I 11. A National Pollution Elimination Permit (NPDES) shall be required from the Colorado <br /> Department of Public Health and Environment (CDPHE), Water Quality Division. <br />1 <br /> <br />1 <br />
