In response to a request from the company to temporarily allow <br />release of minewater through outfall 003, the Division sent a letter <br />to the company dated Januarv 25, 1988 authorizing such a discharge. <br />The letter of January 25 specified that the effluent limitations for <br />outfall 003 (durinc the temporary release) would be the same as the <br />limits presently in the permit for outfall 002. <br />The Division hereby amends the Notice of Violation to add the <br />c,, i ~ ,....t ., ,. .,, _ fl ..' ~.s, <br />You are further notifed that the information contained in <br />naracraphs 16 and 17 of the Findings of Fact constitute violations of <br />Part I A. 1. of the permit as follows: <br />1. The total suspended solids concentrations on Januarv 31 and <br />March 29, 1988 at outfall 002 and the TSS concentrations on February <br />3, Februarv 5, February 6 and February 10, 1988 at outfall 003 exceed <br />the daily maximum concentration allowed by the permit of 70 mg/1, <br />based on a single, grab sample. <br />2. The monthly average concentration of TSS for outfall 002 for <br />March, 1988 and for outfall 003 for February, 1988 exceeds the monthly <br />average concentration allowed by the Hermit of 35 mg/1, based on an <br />average of three or more samples taken during a 30-day period. <br />3, The pH on Januarv 15 and March 3, 1988 at outfall 002 <br />exceeds the maximum pH allowed by the permit of 9.0 s.u., based on a <br />single, grab sample. <br />-2- <br />
