Permit Application #M-99-018,',Nagner Rock <br />TD: Division of Minerals And Geology <br />Dear Sirs, <br />The Colorado First Soil Conservation District board of <br />Supervisors is writing you with regard to the appeal of the <br />COnditlonal Use Gravel Permit No. M-99-018 by Dick and Jane King <br />and Norvall and Donna Hall given to Wagner Construction. we, <br />as a board, are upset with the wcy this permit opplicatlon was <br />presented. Mr. Wagner brought this opplicatlon to' our meeting in <br />March without any mop or legal <~escription for our review. We <br />told him to come to the April meeting with the proper <br />documentation. By the time he n.turned, approval was granted <br />from the Moffat County Planning Commission and the Moffat <br />County Commissioners. n~lr. Wagner presented his plan to the <br />board and quoted State Water Commissioner Walt Rohrer and <br />NRCS Soil Scientist Dennis Moore os saying that the spring would <br />be undamaged by mining and blasting. We spoke to both of <br />these people and they rnode no such claim. Mr. Wagner told us <br />that both had been on the proposed mine site when only Mr. <br />Rohrer had been there to measure the flow of fhe spring when <br />requested to do so by Mrs. King. Mr. Moore had only provided <br />the soil classifications for the site. The one other issue for all three <br />agencies was the exact measurement of the spring relative to the <br />mine site. We were told a dlstanc:e of half a mile when In fact the <br />spring is one tenth of a mile. At ttrat time we notified you by fax <br />our recommendations of no blasting at the site and that iha <br />permit should be reviewed for misrepresentation by Wagner <br />Construction. At that time you cold us that we were too late and <br />that the permit had been issued. <br />
