Mr. Robert Liddle -3- August 23, 1984 <br />4. Location of the disposal site. <br />Blue Ribbon wishes, at this time, to maintain two possibilities for <br />disposal. The first choice is to use the material as a portion of the <br />backfill which is planned for the Blue Ribbon mine bench stabilization <br />project, for which a technical revision has recently been requested. <br />If more detail is needed in regard to our intention to use this sort <br />of material in the mine bench, please refer to the recent technical <br />revision request made to the Division. Blue Ribbon wants to maintain <br />a second option, if some scheduling problems are encountered with the <br />mine bench stabilization project, to dispose of this material prior <br />to November 30th at the currently approved disposal site for underground <br />development waste at Grand Mesa Coal Company. <br />5. Location of stream buffer zones. <br />Blue Ribbon is designating five-foot stream buffer zones on the west <br />bank of Hubbard Creek in the areas A and C'. The established stream <br />buffer zones are located on the attached map. <br />6. Measures to be used to ensure that the stream is not disturbed <br />and that siltation to the water does not occur from the opera- <br />tion. Specific sediment control measures should be described. <br />Sediment control will be established in the areas where machine clean- <br />up will take place. The sediment control device should be effective <br />for approximately one year in order that siltation protection is <br />provided to Hubbard Creek. With the one-year time period in mind for <br />effective sediment control, Blue Ribbon has chosen the concept of <br />using straw bales along the edge of the designated buffer zones. The <br />straw dike will be established just outside the five-foot buffer zone <br />to minimize siltation reaching the creek. The Division will note that <br />there will be material removed within the five-foot buffer zone; <br />therefore, small portions of the reclaimed Areas A and C' will be too <br />close to the creek to allow for effective sediment control. <br />7. Right of entry should be obtained. <br />Blue Ribbon will request the approval of this plan and right of entry <br />for the purpose of meeting the reclamation requirements as established <br />by this plan from the U. S. Steel Mining office located in Paonia, Colorado. <br />The Division should be aware that the planned reclamation proposed in <br />this response can only occur if we receive written approval from <br />U. S. Steel Mining and MLR. If either of those approvals are not <br />obtained by September 17, 1984, Blue Ribbon will notify the Division <br />and alternative plans will be discussed after that date. <br />8. A plan for restoring the stream bank to contain the creek <br />should be provided. This may require importing of some <br />material to use to re-establish the bank. <br />The Areas A and C' requiring machine clean-up are flood plain areas. <br />Most of the coal and interbedded sand lies over the natural stream bed. <br />Blue Ribbon believes that the concept of re-establishing a stream bank <br />which did not exist prior to the Sune 7, 1984 flood should not apply <br />
