Economic Reasonableness Evaluatio Section 15-8-503(8,1 of the revised (June 1985) Colorado Water Oualir! <br />Control Act required the Division to "determine whether or not any or all of the water quality standard based <br />efJluem limitation are reasonably re aced to the economic, environmental, public health and energy imparts tp the <br />public and affected person, and are in furtherance of the ,policies set forth in section 25-8-192 and 25-8-104. " <br />The Regulation for the State Discha ge Permit System, 6..1.0, further define this requiremem under 6.12.0 and <br />state: "Where economic, environme al, public health ana' energy impacts to the public and affected person lutve <br />been conidered in the classificatio and standards setting process, permits written to meet the standards ma;~ be <br />presumed to have taken into canside , Lion economic jactors unless: <br />a) Anew permit is issued where the discharge was not in ezistence at the time of the classification and standards <br />rulemddng, or <br />b) In the case of a continuing discharge, additional injornuttion or jactors have emerged that were not anticipated <br />or canidered at the time of the classification and standards rulemaking. " <br />Furthermore, this is not a new disch¢rger and no new information has been presented regarding the classiftca!ion <br />and standards. Therefore, the water grtaliry standard-based effluent limitation of this permit are determined 'o be <br />reasonably related to the economic, nvironmental, public health and energy impacts to the public and affected <br />person and are in furtherance of rh~ policies set forth in :~ectiou 25-8-102 and 104. /f the permittee disagrees ith <br />this finding, pursuant to 6.12.0(2) (b) the permittee should .submit all pertinent information ro the Division dur r~ <br />public notice period. <br />B.
