The permit outlints the tut requirematts and the required follow-up actions the <br />perminee must take to resolve a toxicity incident. The permittee should read, along with the documents <br />listed in Parts l.A.4.a. and I.A.S.a. of the permit, the Colorado Water OualiN Comrol Division <br />Biomonitorine Guidance Documem, dated July 1, 1993. This documem outlines the criteria used by the <br />Division in such areas as granting relief from WET testing, modifying test methods and changing test <br />species. The ptrmiaee should be aware tha[ some of the conditions outlined above may be subject to <br />change if the faciliry experiences a change in discharge, as outlined in Part I/.A.2. of the permit. Such <br />changes shall be reported ro the Division immediately. <br />6) Exemption for Surface Runoff Only - Outfall 009: The discharges from outfal! 009 contain surface runoff <br />solely and do not comain tonic polGetams in tonic amounts. On this basis, WET testing is not a requirement <br />for this outfall. However, the Division reserves the right to reopen the permit to include WET testing, <br />should faciliry conditions change or if new information becomes available. <br />4. Storntwater Evaluation: Stormwater from active or inactive coal mining operations that has beers contaminated by <br />contact with any overburden, raw material, imermediare products, fitished products, byproducts or waste products <br />located on the site of such operations is required to be covered by a Colorado Discharge Permit System (CDPS) <br />permit in order to be discharged to Waters of the State. This coverage may be obtained under either a CDPS <br />Industrial Wastewater Discharge Permit or a CDPS Stormwater Discharge Permit. Seneca Coal Company submitted <br />an application for a general permit for Metal Mining for the Seneca Mine Complex on February 23, 1996. This <br />facility's certification under the general permit became effective on March 22, 1996. The Seneca Mine Complex <br />certification number is COR-040169. <br />Since the requiremems for stormwater permits have just recemly become effective, the Division's policy is to cover <br />as many facilities as possible that are included in the regulations, with general permits. For facilities that also have <br />individual CDPS permits for discharge of process water, any applicable stormwater provisions would then be <br />. included in individual CDPS permits at the time of individual permit renewal or application. The individual permit <br />for discharge of process water far the Seneca Mine Complex, CDPS permit (No. CO-0000221), will contain <br />stormwater provisions. When this permit becomes ejfecrive, certification COR-040169 will be inactivated. Under <br />the terms of the combined individual permit (CO-0000221), Seneca Coa! Company will be authorized to discharge <br />stormwater associated with industnal activity into waters ojthe State of Colorado. <br />The terms and conditions of this permit, as related to stormwater discharges, include.• <br />a. Se2rexation of Stormwater Discharges: Al! discharges covered by the stormwater portion of this permit shall be <br />composed emirel} of stormwater (except as discussed at Part /.D.2.6.9 of the permit). Stormwater which mites <br />with process water is subject to process water controls. Discharges from sources other than srormwater must be <br />addressed by the process water controls in this CDPS permit. <br />b. Stormwater Mana¢ement Plans (SWMPs1: The purpose of a SWMP is ro identif} possible pollutant sources that <br />may contaminate stormwarer and to set out best management practices that, when implemented, will reduce or <br />eliminate any possible water quality impacts. <br />A SWMP must be maintained for the Seneca Mine Complex in accordance with goad engineering practices. The <br />plan idemifies potential sources of pollution which may reasonably be expected to affect the quality of <br />s[ormwater discharges associated with industrial activity. In addition, the plan describes and ensures the <br />implementation of practices which are to be used to reduce the pollutants in stormwater discharges associated <br />x~ith industrial activity at the faciliry, and assures compliance with the terms and conditions of this permit. <br />Seneca Coa[ Company must implenem the provisions ojthe SWMP as a condition of this permit. Contents and <br />requirements ojthe SWMPare discussed in the permit at Part /.D.2.b <br />c. Compliance Dates: Seneca Coal Company was to have prepared the Seneca Mine Complex SWMP at the time of <br />application . The plan was to have been implememed by upon issuance of the certification. The SWMP shall be <br />updated as appropriate. <br />Certification that a SWMP was prepared for the Seneca Mine Complex was received by the Division on February <br />23, 1996. <br />
