<br />adjacent to the railroad right-of-way for access to the <br />• railroad spur and for use in connection with its coal loading <br />operations at the Loma siding. <br />NOW, THEREFORE, in consideration of the rentals and <br />mutual covenants contained and provided for in this Agreement, <br />the parties agree as follows: <br />1. Grant. Dorchester leases to Salt Creek the <br />surface of the Leased Premises for the purposes of access to <br />the railroad spur and of use in connection with its coal <br />loading operations at the Loma siding. However, the Leased <br />Premises shall not be utilized by Salt Creek for the purpose of <br />. stockpiling coal. It is specifically understood by the parties <br />that Dorchester owns no right, title or interest in the <br />railroad spur or the Loma siding and that it is the obligation <br />of Salt Creek and not Dorchester to make all appropriate and <br />necessary arrangements with, and obtain all consents and <br />approvals from, the Denver & Rio Grande Western Railroad for <br />Salt Creek's use of the railroad spur and Loma siding. <br />2. Reservations. Dorchester reserves for itself, its <br />successors and assigns, the right to utilize the Leased <br />Premises for access to the Loma siding and the railroad spur in <br />the event that the needs of Dorchester so dictate. In that <br />event, Dorchester shall obtain such local, state and railroad <br />permits as are necessary to permit it to use the railroad spur <br />• and Loma siding, and Dorchester agrees that its use of the <br />Leased Premises will not unreasonably interfere with Salt <br />Creek's use of the Leased Premises under this Lease. <br />3. Term.
