• SURFACE LEASE AGREEMENT
This Lease is made and entered into effective as of
the ~ day of /~U~~tT 1982, between Dorchester Coal
Company, a Colorado corporation ("Dorchester"), as lessor, and
Salt Creek [dining Company ("Salt Creek"), a general partnership
organized under the laws of the State of Colorado, whose
general partners are Loma Mining Company, a California
corporation that is a wholly owned subsidiary of Sheridan
Enterprises, Inc., a California corporation, and Mack Fuel
Supply, Inc., a Colorado corporation that is a wholly owned
subsidiary of Colorado-Ute Electric Association, Inc., a
Colorado corporation, as lessee.

RECITALS
A. Dorchester is the owner of approximately seven
acres of land situated in Mesa County, Colorado that are
adjacent to the railroad spur at the Loma siding, commonly
known as the Holly Sugar Beet Dump, of the Denver & Rio Grande
Western Railroad Company, which seven acres of land are more
particularly described as follows:
Beginning at a point that is South OOo 32'
West 955 feet from the North quarter corner
of Section 3, Township l North, Range 3
West, Ute Meridian, thence South 00° 32'
West 231.1 feet, thence North 56° 50' West
1566.9 feet; thence North 00° 32' East
231.1 feet, thence South 56° 50' East
1566.9 feet to the point of beginning,

B. Salt Creek desires to lease from Dorchester a
strip of land (the "Leased Premises") of the above-described
