• SURFACE LEASE AGREEMENT <br />This Lease is made and entered into effective as of <br />the ~ day of /~U~~tT 1982, between Dorchester Coal <br />Company, a Colorado corporation ("Dorchester"), as lessor, and <br />Salt Creek [dining Company ("Salt Creek"), a general partnership <br />organized under the laws of the State of Colorado, whose <br />general partners are Loma Mining Company, a California <br />corporation that is a wholly owned subsidiary of Sheridan <br />Enterprises, Inc., a California corporation, and Mack Fuel <br />Supply, Inc., a Colorado corporation that is a wholly owned <br />subsidiary of Colorado-Ute Electric Association, Inc., a <br />Colorado corporation, as lessee. <br />n <br />RECITALS <br />A. Dorchester is the owner of approximately seven <br />acres of land situated in Mesa County, Colorado that are <br />adjacent to the railroad spur at the Loma siding, commonly <br />known as the Holly Sugar Beet Dump, of the Denver & Rio Grande <br />Western Railroad Company, which seven acres of land are more <br />particularly described as follows: <br />Beginning at a point that is South OOo 32' <br />West 955 feet from the North quarter corner <br />of Section 3, Township l North, Range 3 <br />West, Ute Meridian, thence South 00° 32' <br />West 231.1 feet, thence North 56° 50' West <br />1566.9 feet; thence North 00° 32' East <br />231.1 feet, thence South 56° 50' East <br />1566.9 feet to the point of beginning, <br />± • <br />B.
