faithfully kept, observed and performed the agreements hereof, then <br />• such improvements on said leased premises as may have been purchased <br />by Lessee or erected or placed upon the leased premises by the <br />Lessee shall upon such termination become the property of the Lessee <br />and said Lessee may, or at the request of Lessor, shall, within <br />thirty (30) days after termination of this lease, remove at Lessee's <br />sole expense such improvements on said leased premises as may have <br />been purchased by Lessee or erected or placed upon said premises by <br />said Lessee and restore said premises to substantially their former <br />state in accordance with the provisions of Section 21 hereof, but if <br />Lessee shall be in default upon the termination of this lease, then <br />such improvements on said leased premises as may have been purchased <br />by Lessee or erected or placed upon said premises by Lessee, shall <br />remain the exclusive property of the Lessor; provided further, how- <br />ever, that if at the termination hereof Lessee is in default in any <br />of the agreements herein contained and Lessor shall nevertheless desire <br />Lessee to remove such improvements on the leased premises as may have <br />been purchased by Lessee or erected or placed on said premises by <br />Lessee, and shall so notify Lessee, then all such improvements shall <br />upon such termination become the property of Lessee and Lessee shall <br />remove the same from the leased premises and restore said premises <br />to substantially their former state in accordance with the provisions <br />of Section 21 hereof. <br />• 5. LIENS; It is expressly understood and agreed by and <br />between Lessor and Lessee, and notice is hereby given to all persons, <br />firms or corporations dealing with Lessee in respect of the leased <br />property, that nothing herein is intended or shall be construed so <br />as to authorize Lessee, or any person dealing through, with or under <br />Lessee, to charge the leased property, or any interest of the Lessor <br />therein, or in this lease, with any mechanics' liens or other statu- <br />tory liens whatsoever; but, on the contrary, notice is hereby given <br />to all persons, firms or corporations dealing through, with or under <br />Lessee, that the right and power to charge any ssch lien against <br />Lessor and/or the leased property is expressly denied. <br />Lessee covenants and agrees that Lessee will not permit <br />any material, labor or other lien to attach to said leased property, <br />contrary to the intent of the parties and the notice hereinabove <br />given, which may effect the title of Lessor to the leased property,. <br />and, in the event any such lien shall be recorded, Lessee agrees, <br />within thirty (30) days after such recording, to cause the same to <br />be duly released of record. Lessee further covenants and agrees <br />that, in the event any such lien is placed of record, Lessee will <br />pay Lessor the sum of Ten Dollars ($10.00) for each such lien, in <br />addition to all other expense agreed to be paid by Lessee in con- <br />• nection therewith, to cover Lessor's expense in respect to such <br />liens.
