• for the land and improvements in the name of the Lessor, all such <br />taxes and assessments shall be paid by Lessor before same become <br />delinquent, and Lessee agrees to reimburse Lessor for the full <br />amount of all such taxes and assessments against the improvements <br />within thirty (30) days after receipt of bill therefor; and it shall <br />be the sole obligation of Lessee to determine the assessments made <br />against said improvements and to take whatever action is necessary <br />to modify or change such assessments for a particular year, and, if <br />Lessee shall be dissatisfied with the assessment for a particular <br />year, Lessee shall notify Lessor not later than the first day of <br />January in the succeeding year that Lessee desires to have said <br />taxes and assessments paid under protest, and Lessee shall at <br />Lessee's sole cost and expense prosecute all actions for the recovery <br />of any such taxes and assessments; and, if any such suit shall re- <br />sult in the imposition of additional taxes or assessments with respect <br />to said improvements, Lessor shall pay such additional taxes and <br />assessments and Lessee shall, within thirty (30) days after receipt <br />of the bill therefor, reimburse Lessor for such additional taxes and <br />assessments so paid, but if such suit shall result in refund, Lessor <br />shall pay to Lessee the amount of such refund within thirty (30) days <br />after receipt of the same from the taxing authority, <br />• Lessee shall also pay all charges and assessments for water, <br />gas and electricity used or consumed by Lessee upon the leased <br />premises, <br />3. USE OF PREMISES: Lessee agrees to use said described <br />premises for the following purposes and for no other to-wit: <br />Storage and loading Qt coal into rail cars <br />4, IMPROVEMENTS - Lessee shall maintain all improvements <br />whatsoever which on the date hereof exist upon the leased premises <br />and it is agreed that Lessee may construct improvements upon the <br />leased premises consistent with the purposes of this lease, provided <br />always, however, that the style and type of construction shall be <br />subject to approval by Lessor. All improvements on the leased <br />premises including those which on the date hereof exist upon said <br />premises and those hereafter constructed on said premises shall, <br />during the continuance of this lease, be maintained and painted by <br />the Lessee to the satisfaction of the Lessor, and at all times be <br />kept by the Lessee in a state of good repair, All improvements <br />heretofor or hereafter constructed upon the leased premises shall be <br />deemed to be attached to the land and to be the property of the <br />Lessor, subject to the conditions hereinafter stated; provided, <br />. however, that if at the termination hereof Lessee shall have fully <br />paid the rent herein reserved and shall in all other respects have <br />-2- <br />
