EXHIBIT C-VIII <br />• Lease No. 16 9 ~ 1 <br />THIS LEASE, made and entered into this l~r day of.T„na <br />196y~8, between THE DENVER AND RIO GRANDE WESTERN RAILROAD COMPANY <br />a Delaware corporation, hereinafter called "Lessor", and S1IEI:IDAN <br />EI>;TER.PRISES, INC., a Colorado corporation, 8301 East Prentice Ave., <br />Englewood, Colorado 80110 <br />hereinafter called "Lessee", WITNESSETH, That: <br />1, The Lessor, in consideration of the rents to be paid <br />and the agreements to be performed by Lessee, hereby leases to <br />Lessee premises situate in i~fesa County State of Colorado <br />to-wit: <br />(a) DESCRIPTION - An irregular tract of land of the <br />Lessor varying in width from 69 feet to 80 feet <br />and lying 8.5 southwesterly from the centerline <br />of the Lessor's I.C.C. Track DTo. 11A and extending <br />northwesterly 3210 feet from a point opposite <br />• i•iile Post 464 plus 5080 feet, at Loma, Mesa <br />County, Colorado, as sho~m in red on the attached <br />map, Dwg. No. L-253, containing about 5.57 acres. <br />(b) TERM - To have and to hold said described premises <br />from July 1, 1978 to and until June 30, 1983 <br />unless sooner terminated as hereinafter provided, <br />2. RENT, TAXES AND CHARGES: Lessee agrees to pay Lessor <br />a rental of SIX HUNDRED AND'NO/100 <br />DOLLARS ($ 600.00 )' per annum Payable annually in advance, <br />Lessor shall during the term of this lease, or any extended <br />term, pay or cause to be paid all taxes, assessments and assessments <br />for public improvements levied and assessed against the leased <br />premises; and Lessee shall pay, or caused to be paid, all taxes, <br />assessments and assessments for public improvements levied and assessed <br />• against any improvements placed upon the leased premises by Lessee. <br />In the event the taxing authorities shall fail or refuse to assess the <br />improvements placed,~erected or constructed on the leased property by <br />the Lessee, in the name of the Lessee, but shall render tax statements <br />
