Mr. Gerald B. Mc Rae -2- July 15, 1983
operator. Th1s statute is applicable for any valuable manmade structure
wlthin 200 feet of the affected land. Please obtain such an agreement
for each of the manmade structures on or 1n the vicinity of the affected
(permit) areas.
C. Exhibit D - Mintna Plan
• The text mentions a buffer zone 100 foot wide each side of the
center of the Poudre River w111 be maintained. The Dtvlsion, however,
~. recommends maintaining a 100 foot buffer zone from the bank full stage of
~ \o° the Poudre River inland from that point. Maintaining the 100 foot buffer
~, from the bank full stage rather than the center of the Poudre River is
~FP recommended because this would better maintain the integrity of the river
~ ~ and the six ponds. Also, the riparian vegetatt,on would not be as
1C~ ( drastically affected as well as the sediment load to the river would be
~~' ~,~ minimal. After reviewing the Mining Plan Map, there are only a few areas
~,P ,~~P currently depicted that are wlthin 100 feet of the streambank of the
Poudre River (the Dtvlsion has interpreted the portrayal of the Poudre
River on this map to be when the river 1s at bankfull).
~A. From reading the text, the Division believes the topsoil and
~., overburden will be stockpiled 1n separate piles. Is this correct? To
~~ti maintain topsoil quality the Division would recommend keeping these piles
~u~~ separate.
The following questions pertain to the topsoil stockpile(s).
~~41~ What slope gradients are planned for the stockpile(s)? The
~~- Division recommends a slope of 3h:ly or shallower.
How long w111 the stockpile(s) last? If the pile lasts for
more than one growing season it must be seeded to maintain soil
quality and quantity.
~1. If necessary, what species will be planted and at what rate?
The Dtvlsion recommends a seed mixture of a couple grass species a
nitrogen fixing legume species.
~~~'4,. The text mentions final pond slopes of 4:1, however, the map for
a`~- this exhibit depicts slopes of 3:1. To alleviate any confusion, what
slope gradients are planned for the areas?
atiy''S+ Is Phase II the same as P1t No. 2? if not, please specify where
Phase iI is?
~6„~ Please specify what w111 be used to construct the temporary river
crossing.
a'~ How wide will the access road(s) be?
~ '~s cp
b~ ~ ~~
