This approval is contingent upon the applicant obtaining and maintaining <br />compliance with a valid reclamation permit from the Colorado Division of <br />Minerals and Geology. In addition to these conditions, the operation shall <br />be governed by and limited to that permit. Discrepancies between a <br />permit granted by EI Paso County and a permit granted by the Division of <br />Minerals and Geology may require resolution by the Board of County <br />Commissioners at a public hearing. <br />4. Trucks hauling gravel from the site shall not utilize the eighteen (18) foot <br />right-of-way section of Baptist Road except for construction of the haul <br />A ~pD'~`~ 5 road. The applicant shall be responsible for the construction and mainte- <br />~/,~ ~~,,,r~'`l,~~k3 Hance of the private haul road. The speed limit on the haul road shall not <br />gyp, '~ exceed 20 miles per hour, and the applicant is responsible for installation <br />(~ ~~~~r`ti of "stop" signs on the private haul road at locations entering or crossing <br />~'' Baptist Road. Prior to commencing construction of the hau! rcad, the <br />applicant shall obtain and provide a copy to the Planning Department <br />valid access permit(s) from the EI Paso County Department of Public <br />Works and any necessary Federal, State or local construction permits for <br />the Beaver Creek crossing. With the exception of extracting gravel for the <br />haul road construction, no mineral extraction shall take place until the <br />haul road has been constructed and all traffic devices have been set in <br />place, which are satisfactory to the EI Paso County Department of Public <br />Works. The applicant is responsible for compliance with any conditions <br />placed upon the approval of the access permit. <br />5. Prior to beginning operations the applicant shall develop a weed control <br />plan to the satisfaction of the Soil Conservation Service. <br />6. The duration of this Use Subject to Special Review shall be limited to ten <br />(10) years from the date of Board of County Commissioners' approval. <br />This is not intended to limit the Board of County Commissioners' ability to <br />periodically review this project under Section 35.8 (D) of the EI Paso <br />County Land Develo ment ~,qde. <br />7. A copy of the E.P.A. Stormwater Management Plan and permit application <br />shall be submitted to EI Paso County Planning Department and EI Paso <br />County Department of Public Works for review and comment when <br />required by the Stormwater regulations. <br />8. Topsoil stockpiles and visual screening berms shall be revegetated or <br />quick-seeded if left undisturbed for more than one (1) year. <br />~ -i <br />
