• Kaiser is also in possession of a valid Air Quality Emission Permit. Fugitive dust control <br />measures are employed as an integral part of the surface mining and reclamation operations. <br />Compliance with this permit effects compliance with the Clean Air Act and the Colorado <br />Pollution Control Act. Exhibit 9, Air Pollution Information, provides additional information <br />concerning the status of Kaiser's emission permit. Additional information concerning air <br />pollution control measures is presented in Section 2.05.6. <br />2.05.6 Miti,g_ation of Surface Coal Mining Operation Impacts <br />Air Pollution Control Plan <br />As previously discussed, Kaiser maintains air quality at the mine site through proper <br />application of water to those areas requiring dust suppression. Fugitive dust control <br />measures are an integral part of all surface mining and reclamation activities. Kaiser Steel <br />is in possession of a valid existing emission permit, No. C-11, 240-1 and C-11, 240-2 (Exhibit <br />8), however, because of cessation of mining operations, no mitigation measures are <br />necessary. <br />Fish and Wildlife Plan <br />Section 2.04.11 describes the measures that the Chimney Rock Mine has pursued in order <br />to establish an acceptable fish and wildlife plan. Section 2.04.11 also addresses current fish <br />• and wildlife use of the permit area and adjacent areas, as well as considerations which have <br />been given to the protection of those species considered rare or endangered. <br />Further, reclamation of the mined ares to wildlife habitat/rangeland will restore the land to <br />its premining use. Among the essential requirements, a food source will be provided. A <br />food source will be realized in that the grass species, as well as the forb species proposed <br />to be utilized, are of nutritional value to the varieties of ruminant wildlife species known to <br />inhabit the area. Reports prepared by the Colorado Division of Wildlife indicate that the <br />varieties of Wheat Grass, Kentucky Blue Grass, and Indian Rice Grass, are utilized by <br />herbivores during the various seasons of the year. <br />The proposed post mining ]anduse of wildlife/rangeland will restore the area to its premining <br />use. Addition of the species, referenced above, to the ecosystem should enhance the ability <br />of the reclaimed land to support wildlife use insomuch as it occurs in the area. <br />As previously stated, no threatened or endangered animal and plant species are known to <br />exist on the property. Peregrine falcons nest on Chimney Rock and Companion Rock which <br />are located approximately 2 miles to the northeast of the mine site. Given the size and <br />location of the surface miming operations, it is doubtful that such operations will affect the <br />falcons or habitat critical to the continued used if Chimney Rock and Companion Rock as <br />a nesting, brooding and rearing site. Further, the Chimney Rock Mine site is not identified <br />as critical habitat to rare and endangered wildlife species or other non-endangered species. <br />• 2.05-16 <br />
