Page 2&i <br />Section 4.05.17 <br />4:05 :11•• Y~~~r .•.P os tinin in g: an d Refi_ab it ita•ti oiiao f~Se 81.menta ti on <br />..?_._. <br />P~o~ds, Diversions, Lnpouridmetits,.:and Treatment <br />Fa'ci ] i ti es . <br />120(2) Before abandoning the permit area, the person who conflicts <br />(j )(III) the surface or underground mining activities shall renovate all <br />permanent sedimentation prods, diversions, impoundments, and <br />treatment facilities to meet criteria specified in the detailed <br />design plan for the permanent structures and impoundments. <br />4.05.18 ~ Stream Buffer Zone <br />120(2)(x) (1) No land within 100 feet a~ greater distance if <br />required by the Division, of a perennial stream or stream with a <br />biological community determined in accordance with 4.05.18(3) <br />shall be disturbed by s!n-face coal mining operations, except in <br />accordance with 4.05.3-4.05.4 unless the Division sperifically <br />authorizes surface or underground mining activities closer to or <br />through such a stream upon finding: <br />(a) That the original stream channel will be <br />restored; and <br />(b) During and after the mining, the water <br />quantity and quality from the stream section within 100 feet of <br />the surface coal mining operations shall not tie adversely <br />affected. <br />(c) That the operations reclama!:ion plan provides <br />far the reestabl ishment of appropriate ri parian vegetation. <br />(2) The area not to be disturbed shall be designated a <br />stream buffer zrne and marked as sped fied in 4.02. <br />I3) A stream with a biological community shall be <br />determined by the existence in the stream at any time of an <br />assemblage of two or more species of arthropods or molluscan <br />animals wfii ch are: <br />(a) Adapted to flowing water for• all or part of <br />their life cycl e; <br />~..~ <br />\~~ " <br />
