Page 34 ~ <br />Section 1.04 <br />(1311 "Surface coal mining activities" means those surface <br />coal mining and reclamation operations incident to the <br />extraction of coal from the earth by removing the materials over <br />a coal seam , before removing the coal , by au ger coal mining or <br />by recovery of coal from a deposit that is not in its original <br />geologic lowticn. <br />1132) "Surface coal mining operations" means: <br />(a) Activities crncarcted on the surface of lands <br />in connection with a surface coal mine or activities subject to <br />the requirements of Section 34-33-121 of the Act and Rule 4 <br />which involve surface operations and surface impacts incident to <br />an underground coal mine. 5~ch activities include excavatfon <br />fnr the purpose of obtaining coal, including suds co~rmon methods <br />as contour, strip, auger, mountaintop removal ,box cut, open <br />pit, and area mining, the use of explosives and blasting, and <br />the use of in situ distillation or retorting, leading or other <br />chemical or physical processing, and the cl eaning, <br />concentrating, or other processing or preparation, loading of <br />coal for interstate commerce at or near the mine sit,; except <br />that such activities do not include any of the following: the <br />extraction of coal incidental to the extraction of other <br />minerals where coal does not exceed 16-2/3 percent of the <br />tonnage of minerals removed for purposes of commercial use or <br />sale, or coal exploration subject to section 34-33-117 of the <br />Pct and 2.02, the exploration once extraction of natural <br />petroleum in a liquid or gaseous state by means of •~ve11s or <br />pi pe, or the extraction of geothermal resources; and provided <br />further, that excavation for the purpose of ebtainin~l coal <br />includes extraction of coal from coal refuse piles; ~+nd <br />(b) The areas upon which such activities occur or <br />where sud+ activities distur'o the natural land surface. Such <br />areas shall also include any adjacent land the use of ~Jnich is <br />incidental to any such activities, all lances affected by the <br />construction of new roads or the improvement or use of existing <br />roans to gain access to the site of such activities a.na for <br />haulage, excavations, workings, impoundments, dams, ventilation <br />shafts, entryways, refuse banks, dumps, stockpiles, overburden <br />piles, spoil banks, culm banks, tailings, holes or depressions, <br />
