GENERAL TERMS AND CONDITIONS: IIMPORTANTI READ ITEMS 8.7 AND 81 • <br />1. This permit is issued in reliance upon the accuracy end completeness of information supplied by the applicant end is <br />conditioned upon conduction of the activity, or constructon, installation end operation of the source, in accordance <br />with this information end with representations made by the applicant or applicant's agents. I[ is valid only far the <br />equipment end operations or activity specifically identified an the permit. <br />2. Unleae specifically stated otherwise, the general end specific canditione contained in this permit have been determined <br />by the APCD to be necessary to assure compliance with the provisions of Section 2 5-7-1 1 4141181, C.R.S.and, as such, <br />shell be enforceable under the provisions of Section 25-7-115, C.R.S., the Clean Air Act, 42 USC Section 750216)131; <br />and Air Queliry Control Commission Regulation No. 3 Section IV.D.2. or 121 result in an exceedence of the NAAOS for <br />pollutants es required by Sections 25-7-1051111A1(11 end 201111(6). C.R.S., of the Clean Air Act; 42 USC Section <br />74751e113); end Air Quality Control Commission Regulation No. 3, Section IV.D.1 .c. <br />3. Each end every condition of this permit is a materiel pert hereof and is not severable. Any challenge to or appeal of, <br />e condition hereof shell constitute a rejection of the entire permit end upon ouch occurrence, this permit shell be <br />deemed denied eb inirio. This permit maybe revoked et any time prior [o final epprovel by the Air Pollution Control <br />Division (APCD) on grounds set forth in the Colorado Air Queliry Control Ac[ aM regulations of the Air Quality Control <br />Commission (AQCCI, including failure to meet any express tans or condition of the permit. <br />4. This permit end any required attachments must be retained end made eveilable for inspection upon request et the <br />location set forth herein. With respect to a portable source which is moved to a new location, a copy of the revised <br />Air Pollutant Emissions Notice IAPENI (required by law to be submitted to the APCD whenever a porte6le source is <br />relocated) should be attached to this permit. The permit may be reissued to a new owner by the APCD es provided <br />in AQCC Regulation No. 3 Section III.B. upon a request for transfer of ownership and the submittal of a revised APEN <br />end the required fee. <br />5. Issuance (initial epprovel) of en emission permit does not provide "final" authority for this activity or operation of this <br />source. Final epprovel of the permit must be secured from the APCD in writing in accordance with the provisions of <br />25-7-114(4)Ijl C.R.S. end AQCC Regulation No. 3, Section IV.H. Final epprovel cannot be granted until the operation <br />or activity commences and has been verified by the APCD es conforming in ell respects with the conditions of the <br />permit. If the APCD so determines, it will Orovida written documentation of such final epprovel, which does constitute • <br />"final" authority to operate. <br />6. THIS PERMIT AUTOMATICALLY EXPIRES IF you 111 do not commence construction or operation within 18 months <br />after either the date of issuance of this pernit or the date on which such construction or activity was scheduled to <br />commence es set forth in the permit, whichever is later; (21 discontinue construction for a period of 18 months or <br />more; or 131 do not complete construction within a reasonable time of the estimated completion date. Extensions of <br />the expiration date may ba granted by the APCD upon a showing of good cause by the permittee. <br />YOU MUST notify the APCD at least thirty days (fifteen days for portable sources) prior to commencement of the <br />permitted operation or activity. Failure to da ea is a violation of Section 2 5-7-1 1 41411j1. C.R.S. end AQCC Regulation <br />No. 3, Section IV.H.1., end can result in the revocation of the permit. <br />8. Section 2 5-7-1 1 41511e1. C.R.S. requires that ell sources required to file en Air Pollution Emission Notice (APEN) must <br />pay en annual fee to cover the costa of inspections end edminietretion. If a source or activity is to be discontinued, <br />the owner must notify the Division in writing requesting a cancellation of the permit. Upon notification, annual fee <br />billing will terminate. <br />9. Violation of the terms of a permit which hee received final approval or of the provisions of the Colorado Air Quality <br />Control Act or the regulations of the AQCC may result in edminietretive, civil or criminal enforcement actions under <br />Sections 25-7-115 (enfarcementl. -121 (inryncdonal, -122 (civil penalties).
