Process water discharges an addnsud under Par! I.B ojthe permit; stormwater discharges arc <br />addnssed under Part /.C ojthe permit. <br />This will eliminate the need jar roverage under more than one ptrmir for most such facilities. However, as discussed in <br />Section V.A.2.a of the Rationale, some facilities may wish to apply for an individual pemrit instead, in order to take <br />advantage of some federal ejjluem guideGnu not included here. Additionally, as discussed in Section IILB of the <br />Rationale, the Water Quality Comrol Division of the Colorado Deparrmtnt of HeaUh (the 'Division J stains the authority <br />to require any facility to be rovrred under an individual permit. <br />111. COVERAGE UNDER THIS PERMIT <br />A. New Industrial Categories <br />The type ojjacilitits mvmd by this permit has been broadened to include all mining and quarrying of nonmetallic <br />minerals, except fuels. lhis it the description of Standard Industrial Class~carion (S/C) Code 14. The permit <br />previously rovered only ronstruction sand and gravel mining (S/C Cade 1442), but has been changed to include <br />these new categories due to the addition of stormwater provisions jot chest same categories (see Section V.B of the <br />Rationale). ALso, stormwater from asphalt and mnotte batch plants located at sand and gravel operations is <br />included titre, due to their similariry ro the rovered mines in pollution potential, and their function as an adjunct to <br />the mine operations. (Ihe dejtnition of asphalt and mnnete batch plants cart include the use of recycled asphalt or <br />ronnete) <br />The new categories include: <br />S/C Cock /ndustrv Twe <br />141 Dimension stone <br />142 Crushed and broken stone <br />144 Sand and grout! <br />l45 Clay, ceramic, and refractory mistrals <br />147 Chemical and fertilizer mineral mining <br />148 Nonmetallic minerals services, except fuels (e.g., overburden removal, strip mining, <br /> etc.1 <br />149 Miscellaneous nonmetallic minerals, eeoept fuels (e.g„ asbestos, gems, ft!! dirt pits, <br /> graphite, gypsum, peat, pumice, talc, ete.J <br />2951 Asphalt batch plums <br />NA Conadc batch plants <br />B. Geneml vs. Individual Permit Covemre <br />Any owner or operator authorized by this permit may request to be excluded from the menage of this permit by <br />applying jot an individual CDPS permit The owner or operator shall submit an itdividua/ application ro the <br />Division, with reasons supporting the request. <br />Alternately, if, after evaluation of the application (or additional information, such at the SWMPJ, it is found that <br />this genera! permit is sat applicable to the operation, then the application may be processed as one for an <br />individual permit, or a more appropriate general permit. The applicam will bt mt~ed of the Division's decision ro <br />deny certification under this general permit. <br />G F.xemottons !or Minor Municipalities <br />The lntermodal Surface Transportation Effrcimcy Act of 1991 has resulted in some modifications ro the stormwater <br />regulations. Section 1068(cl of the Transportation Act has added an exemption to the stormwater regulations for <br />municipalities with less than IQD,OW population.
