<br />facility. The results of the analyses are to be furnished directly both to the <br />Division and Wyoming Fuel Co. as soon as available. Sampling and analysis of the <br />water at these points will continue on this basis until final approval is secured <br />of the technical revision required in Step 2 of this abatement and the monitoring <br />program therein can be implemented. <br />Should, in the opinion of the Division based on all information available to it, <br />the concentrations of any additives previously employed in the treatment facility <br />be revealed at any point or time by this temporary monitoring program to be capable <br />of more than minimally disturbing and/or adversely impacting the aquatic <br />environment, Wyoming Fuels, upon notice by the Division of this opinion, shall <br />promptly for Division approval submit a plan to alter their operation and to reduce <br />the concentration of the additive to levels acceptable to the Division. Wyoming <br />Fuel Compagy shall then promptly implement what ever plan is approved in this <br />regard by the Division but not later than one week following receipt of that <br />written approval. Should such approved plan not be implemented within the required <br />time, all discharge of contaminated mine water shall cease. <br />Step 2: Submit a complete and adequate technical revision, according to the <br />requirements of the Division, describing in detail the entire system of mine water <br />treatment and monitoring to be employed in order to ensure minimization of <br />environmental impacts and prevention of material damage. The details to be <br />provided shall include, but shall not necessarily be limited to, those described in <br />the attached CMLRD Coal Section Memorandum dated February 12, 1986. <br />Step 3: Secure final approval by the Dl vision of the technical revision submitted <br />in Step 2 of the abatement prior to any modifications of the system. <br />Step 4: Implement the treatment system and monitoring program approved in Step 8 <br />of the abatement. <br />Time for Abatement: <br />Step 1 is to commence immediately and continue until the monitoring program <br />included in the technical revision approved in step 3 of the abatement is <br />implemented. <br />Step 2 is to be completed by Mdy ], 198 - <br />Step 3 is to be completed within 70 ddys of the Division's receipt of the <br />complete technical revision required in Step 2 of the abatement. <br />Step 4 is to be completed within 30 days of the date of final approval of the <br />technical revision received in Step 3 of the abatement. <br />Affirmative Obligation(s) to Abate Imminent Danger or Harm. <br />Cease immediately the use of any unapproved additive, including flocculant or <br />coagulant, for treatment of mine water before its discharge. <br />/bdc <br />6468E <br />
