<br />Cessation Order No.: C-88-017 <br />Nature of Condition, Practice, or Violation: <br />Failure to adhere to the conditions of the permit thus violating the permit <br />and causing or being reasonably expected to cause significant environmental <br />harm to land, air, or water resources. Failure to maintain a support facility <br />to prevent damage to fish, wildlife, and related environmental values, <br />Failure to conduct surface coal mining operations to minimize disturbances and <br />adverse impacts of the operations on fish, wildlife, and related environmental <br />values. Specifically, a flocculant or coagulant not described in the permit <br />application nor approved in the permit was used by the operator as part of the <br />treatment of mine water prior to its discharge into the natural surface water <br />drainage system. This flocculant or coagulant or other additive to the mine <br />water in the treatment facility was then directly discharged in company with <br />the mine water in quantities lethal to fish resident in that natural surface <br />water drainage system. <br />Act or Permit Provision(s) Violated: <br />Act Section(s): 34-33 subsections 108(1), 114 (2 )(e)(I)(B), 120(1), 120(2)(j) and <br />(X ), 121 (2)(i) and (k ), and 123(1). <br />Permit Section(s): 2.05.6 <br />Regulation Section(s): 5.03.2 (1)(a), 4.18(1), 4.04 (1)(a), 4.05.2(1) and (2) and (7) <br />and (9 ), 2.05.6(3 )(a)(1) and (b ). <br />Portion of the Operation to which Order Applies: <br />That portion of the mine water treatment facility whereby flocculant or <br />coagulant or other additives are introduced into the mine water before it is <br />discharged into the natural surface water drainage system. <br />Findings - The condition, practice or violation is causing or can reasonably be <br />expected to cause significant imminent environmental harm to land, air, <br />or water resources. <br />Operation(s) to be Ceased Immediately: <br />The use of any unapproved additive, including flocculant or coagulant, by <br />unapproved means in the treatment of mine water before its discharge. <br />Steps Necessary to Abate Cessation Order No. C-88-017 <br />Step 1: Institute a water quality monitoring program for the mine water discharge, <br />Ciruela Canyon, and the Purgatorie River. For comparative purposes and in order to <br />establish the current and future character of the aquatic environment within and <br />adjacent to the permit area, samples are to be taken immediately and at 14-day or <br />shorter intervals thereafter of 1), the mine water being discharged from the <br />treatment ponds at sampling point MDGE-1; 2), tlne water in the Ciruela Canyon <br />drainage at established sampling points CCS-1 and CCS-2, and 3). the water in the <br />Purgatorie River at established sampling points PRS-2 and PRS-3. The samples are <br />to be promptly submitted for immediate analysis by whatever laboratory or facility <br />' approved by the Division as competent to do so to determine the presence and <br />concentrations of any additives previously employed in the mine water treatment <br /> <br />
