• Please note that two (2) copies of your response to the objectors' concerns and all outstanding adequacy <br />concems of the Division must be submitted and received by the Division no lacer than August 19, 2005 to <br />allow Division staff sufficient review time. If the applicant requires additional time to adequately respond <br />to the concerns presented in this letter, the applicant may elect to request an additional extension of the <br />recommended decision date. Such a request must be made in writing and must be received on or before <br />August 19, 2005. Please be advised that you will need to provide all information or commitments <br />- -- --requested-and/or-resolve all remaining-concems.of-the-Division-on or-before-theSeptember-16,-2005-- - -- - - <br />recommendationdate. Failure to do so will result in a Division recommendation of denial of your <br />application. <br />6.4.4 EXHIBIT D - Minine Plan <br />Uranium Mineralization <br />22. The applicant has proposed a Monitoring, Containment, and Control Plan to address the potential for <br />adverse impacts to human health, and the environment from uranium mineralization resulting from <br />quanying activities and to ensure the operator's compliance with all applicable Federal, State, and local <br />regulations. During the previous review period, the Division met with representatives from the Air Quality <br />Control Division and Radiation Management Program of CDPHE to discuss the concems expressed by <br />objector T.L. Turner in reference to uranium mineralization from quarrying activities. As a result of our <br />discussion, the Division believes it is appropriate for the applicant's Monitoring, Containment, and Control <br />Plan to address the presence and impacts of radioactivity rather than just for uranium. The Division <br />• recommends that you contact the appropriate CDPHE agency to assess necessary monitoring requirements <br />and protocol. The attached response from CDPHE to the Division's request for information is of a general <br />nature and not specific to your proposed operation. You should contact CDPHE for guidance specific to <br />your proposed operation and then submit a revised plan to the Division for its review. <br />23. The applicant has proposed to "collect drill cuttings Gom at least one (1) representative sample point <br />and promptly perform assay work for uranium content." in order to ensure that your proposal is adequate, <br />the Division recommends that you contact the CDPHE for guidance specific to your proposed operation <br />regarding this issue and then submit any additional information and revision to your proposal to the <br />Division for its review. <br />24. The DMG has no jurisdiction over airborne radioactive dust. The Division recommends that you <br />contact the CDPHE for guidance specific to your proposed operation regazding this issue. Please keep in <br />mind that Rule 6.3.6 requires applicants to list in its application alt permits or licenses held or to be sought <br />in order to conduct the proposed mining operation. <br />25. Slricken from further DMG consideration. <br />26. The applicant has committed to monitor for the presence of uranium in runoff from the site. <br />The Division believes that it is appropriate to monitor for radioactivity in sediment ponds or other on-site <br />water holding structures because these can act as rechazge structures to groundwater. Please respond to <br />this concern. In addition, please provide a sampling protocol and operational measures to ensure that <br />CDPHE surface water standazds will not be violated. The Division recommends that you contact the <br />CDPHE for guidance concerning surface water standazds specific to your proposed operation and then <br />• submit to the Division for its review an acceptable surface and groundwater monitoring plan for <br />radioactivity- <br />
