• 27. The applicant has proposed to monitor particulate and dissolved uranium in all waters concentrated on <br />the site at a point of discharge for compliance with the radioactivity standazd of 40 pCi/L or natural <br />background, whichever is higher. Please verify that the 40pCi/L or natural background concentration is a <br />monitoring standard acceptable to CDPHE. Also, please explain how the natural background and <br />operational pCi1L levels will be determined, sampled, and reported? Finally, please provide the Division <br />with a mitigation plan that will be implemented in the event the proposed standard is exceeded. The <br />---------Division~eeommends-that-you-contactthe-C-DPHE-for-guidance on-develepment-of~an-appropriate ------- <br />mitigation plan. <br />28. The applicant has discussed a variety of mitigation measures including pre-moistening of rock and <br />other dust suppression techniques. Pleasc verify if the applicant will be storing toxic and/or hazardous <br />materials on site that will be used as a mitigation measure. If so, please explain the storage and control <br />methods to be used. <br />29. Stricken from further DMG consideration. <br />30. The applicant has stated that a "preliminary geologic assessment prior to operations will provide [no] <br />useful answers regazding the potential effect of mining on any mineralized uranium." Please respond why <br />it will not be necessary for the applicant to collect, at a minimum, a one-time representative sampling of <br />ambient background radiation levels from the rocks at the site. <br />Once again, we will look forwazd to your response to Division adequacy concerns and Objector comments <br />on or before August 19, 2005 to allow adequate time for review before the September 16, 2005 Division <br />• decision date. Please be sure to include two (2) copies of all documents. Rule 1.8.1 states that changes and <br />additions to the pemrit application must be filed with the Division and the applicable County Clerk and <br />Recorder.
